MPSCDRC, Bhopal - Consumer Complaint no. 49 of 2016 - Eid Mohd. vs National Ins. Co. Ltd. -
Consumer complaint filed by Eid Mohd. alleged that insured truck was stolen, which FIR was lodged under Section 379 IPC with PS Pipalrawan, Dewas at crime No.301/14 dated 22/09/2014. Insurance claim denied by company as in investigation the FIR of insured truck lodged at crime No. 301/14 dated 22/09/2014 at PS Pipalrawan, Dewas, was forged.
In Complaint case Insurance Company taken defense accordingly and filed PS Pipalrawan RTI certified copy of Original FIR lodged by Rameshchand for theft of 5 HP submersible motor pump at crime no. 301/14 dated 04/11/2014 and also raised preliminary objection regarding false complaint case and dismiss it at initial stage.
After that Complainant also filed SP, Dewas RTI certified copy of FIR crime no. 301/14 dated 22/09/2014, thereafter insurance company verified the Complainant’s RTI certified copy which again found forged.
The FIR lodged by complainant and the FIR lodged by Rameshchand were totally inconsistent and ran counter to each other, therefore Hon’ble Commission by order dated 18.4.2017 directed SP, Dewas to hold an enquiry and place before the Commission genuine and correct FIR in respect of crime No.301/14 of PS, Pipalrawan, Disrict Dewas.
In response to above direction, an enquiry was held by DSP HQ/Traffic, Dewas and report dated 29.1.2018 was submitted before Hon’ble Commission. According to report the FIR lodged by the complainant on 13.8.2014, crime No.301/14 under Section 379 IPC was registered on 22.9.2014, but the said FIR was not found in PS, Pipalrava. Said FIR purports to have been recorded on page No.46 in FIR book No. 1492, but this FIR book did not belong to PS, Pipalrava. During enquiry an information was sought from Record Branch of D.P.O. Dewas about distribution of book No. 1492, whereupon it was found that in the period between years 2006 to 2016, no book having No.1492 was distributed in Dewas. It was further found that book No. 1492 was not at all printed by the Deputy Controller of Regional Press, Gwalior, Bhopal and Indore. It has been mentioned in the enquiry report that signatures of Inspector Bhadoria on the FIR presented by Eid Mohammed are doubtful. After making other enquiries and recording statements of concerned persons the Enquiry Officer/Deputy Superintendent of Police, reported that the copy of alleged FIR produced by the complainant regarding theft of his truck was forged/fabricated. It could be possible that for obtaining false claim the story of theft of truck was concocted and documents were fabricated.
On the basis of enquiry report Hon’ble Commission allowed preliminary objection and dismissed the complaint.
