9.The substance of the complaint was not related to paternity of the children of the respondent no.2 but the question was whether the offences under the aforesaid provisions of the 1860 Code was committed against her or not. The paternity of the two daughters of the respondent no.2 is a collateral factor to the allegations on which the criminal case is otherwise founded. On the basis of the available materials, in our opinion, the case out of which this proceeding arises could be decided without considering the DNA test report. This was the reasoning which was considered by the Coordinate Bench in the case of Ashok Kumar (supra), though that was a civil suit. Merely because something is permissible under the law cannot be directed as a matter of course to be performed particularly when a direction to that effect would be invasive to the physical autonomy of a person. The consequence thereof would not be confined to the question as to whether such an order would result in testimonial compulsion, but encompasses right to privacy as well. Such direction would violate the privacy right of the persons subjected to such tests and could be prejudicial to the future of the two children who were also sought to be brought within the ambit of the Trial Court’s direction.

“23. It is well settled that a judgment is a precedent for the issue of law that is raised and decided. A judgment is not to be read in the manner of a statute and construed with pedantic rigidity. In Amardeep Singh Vs. Harveen Kaur (supra), this Court held that the statutory waiting period of at least six months mentioned in Section 13B (2) of the Hindu Marriage Act was not mandatory but directory and that it would be open to the Court to exercise its discretion to waive the requirement of Section 13B(2), having regard to the facts and circumstances of the case, if there was no possibility of reconciliation between the spouses, and the waiting period would serve no purpose except to prolong their agony.”

1. यह साबित करना होगा कि आरोपी द्वारा बाधा डाली गई थी;

2. इस तरह की रुकावट ने किसी व्यक्ति को उस दिशा में आगे बढ़ने से रोका जिस पर उसे आगे बढ़ने का अधिकार था;

3. अभियुक्त ने स्वेच्छा से ऐसी बाधा उत्पन्न की। अवरोधक का इरादा होना चाहिए या पता होना चाहिए या उसके पास यह विश्वास करने का कारण होना चाहिए कि अपनाए गए साधन शिकायतकर्ता के लिए बाधा उत्पन्न करेंगे।

11.इसमें कोई संदेह नहीं है कि डीएनए विश्लेषण याचिकाकर्ता के पक्ष में सामने आया है, क्योंकि वह जैविक पिता नहीं है। यह, इस न्यायालय के सुविचारित दृष्टिकोण में, याचिकाकर्ता को इस तरह के कथित अपराधों के लिए पूरी तरह से दोषमुक्त नहीं करेगा। विश्लेषण के कारण पितृत्व संदेह में रहा होगा। कथित कृत्य बिल्कुल नहीं हुआ है, यह अनुमान नहीं हो सकता है कि याचिकाकर्ता के पक्ष में डीएनए नमूना आने के कारण निकाला जा सकता है। अन्यथा भी, विश्लेषक द्वारा दी गई डीएनए नमूना रिपोर्ट की भी साक्ष्य के माध्यम से पुष्टि की जानी है। इस न्यायालय के समक्ष केवल डीएनए नमूना रिपोर्ट पेश करने का अर्थ यह नहीं है कि इसे उस डॉक्टर की परीक्षा या जिरह के बिना सुसमाचार सत्य के रूप में लिया जाना चाहिए जिसने ऐसी राय दी है।

12.......यदि 12 साल का बच्चा विद्वान मजिस्ट्रेट के सामने जो कुछ भी कहता है, जैसा कि यहां ऊपर उद्धृत किया गया है, ध्यान दिया जाता है, वे सभी याचिकाकर्ता की ओर से अक्षम्य कार्य हैं जब तक कि अन्यथा साबित न हो। डीएनए परीक्षण याचिकाकर्ता को बच्चे के पिता के रूप में बाहर कर देगा, लेकिन पीड़िता ने अपने 164 Cr.P.C में जो कहा है, उसे बदनाम नहीं कर सकता। बयान में कहा गया है कि याचिकाकर्ता ने जबरन उसके साथ यौन संबंध बनाए। उक्त बयान में वर्णित पीड़िता की गवाही पर अविश्वास करने का कोई कारण नहीं है। याचिकाकर्ता के खिलाफ लगाए गए आरोपों के संबंध में डीएनए परीक्षण को निर्णायक सबूत नहीं कहा जा सकता है। डीएनए परीक्षण को एक पुष्ट साक्ष्य के रूप में सबसे अच्छा इस्तेमाल किया जा सकता है।....................सुप्रीम कोर्ट द्वारा सुनील (सुप्रा) के मामले में दिए गए फैसले के आलोक में, अचूक निष्कर्ष होगा, अगर डीएनए का सकारात्मक परिणाम आरोपी के खिलाफ आता है, तो यह उसके खिलाफ आगे की कार्यवाही के लिए एक ठोस सबूत होगा। . यदि परिणाम नकारात्मक है अर्थात अभियुक्त के पक्ष में है, तो अन्य सामग्री के वजन और रिकॉर्ड पर साक्ष्य को अभी भी पुष्टि के लिए विचार करना होगा। इसलिए, यह इस तरह के निर्णायक सबूत नहीं बनाता है जिसके परिणामस्वरूप मामले में आरोपी, याचिकाकर्ता के खिलाफ कार्यवाही समाप्त हो जाएगी।
