Permanent Residency on the basis of Humanitarian and Compassionate Grounds is for the applicants who otherwise are not eligible to apply PR under any other class. Thus, the application needs due diligence as this is the only chance for applicants to stay in Canada.
Our clients came to Canada on a visitir visa and claimed refugee protection at the POE but their claim was later rejected by RPD. Then, they appealed in RAD but again rejected. Clients were feeling very helpless. Their lawyer was reluctant to apply their H&C application because their is a condition under which, clients have to wait for 12 months after their rejected appeal to apply for H&C. But, our clients falls under an exemption which states that if you have a Canadian Born Child then you will be exempted from this condition thus we started preparing for their H&C application in July 2021 and submitted in September 2021. Thus, after 14 months i.e in November 2022 we got AIP( Approval in Principle). Then we applied PR and our clients got COPR in March 2023 and they are happily settled in Canada as Permanent Residents. This story was worth sharing and will be inspiring for many who have lost all hopes.
