📺 On Now: My legal view on the notice to actor , a citizen and card holder.
The Supreme Court, in Anushka Rengunthwar v. Union of India, noted that the right of OCI card holders is a midway right in the absence of dual citizenship. https://lnkd.in/gBsRjrn8
On a number of occasions, Indian courts have upheld the rights of OCI card holders where government officials ordered deportation or cancelled an OCI card without following due process of law, or for reasons other than those mentioned in the Citizenship Act, 1955.
However, when Indias foreign exchange reserves go down, it is OCI card holders who are asked to remit foreign funds to India.
And when an OCI card holder achieves something in their foriegn country, the media and government officials take pride in mentioning that the person is of Indian origin.
Government officials need to educate themselves on the relevant provisions of law and stop violating the rights of OCI card holders on an ongoing basis.
