Marriage in the Philippines - LEGAL CAPACITY DOCUMENTS
In the past, a foreign resident who wished to marry a woman in the Philippines was required to present LEGAL CAPACITY DOCUMENTS.
This requirement was canceled. However, some Israeli clients of our firm have informed us recently, that certain officials in the Philippines asked them for this certificate.
We helped our clients finding the necessary solutions, and the clients were indeed married.
However, we feel that there is a need for re-examination of the matter, and providing clarifications and redesigning the legal requirements, in order to make it easier for spouses who wish to marry.

בעבר, תושב זר שביקש להינשא לאשה בפיליפינים, נדרש להציג אישור כשירות משפטית.
לקוחות ישראלים של משרדי שביקשו להינשא לאחרונה בפיליפינים, דווחו לנו כי פקידים מסויימים חזרו להעלות את הדרישה הנ"ל. לאחר טיפול נמצאו הפתרונות הדרושים, והלקוחות אכן נישאו בשעה טובה.
לדעתנו יש צורך בבדיקה של המצב, מתן הבהרות ותיאום מחודש של העניין בידי משרדי החוץ של המדינות השונות עם השלטונות המקומיים בפיליפינים.

NEW AGGRIMENT – NO BROKERAGE FEES
We have now been informed that the Israeli Interior Minister, Aryeh Deri, and the Philippine President, Rodrigo Duterte, sighed today a bilateral agreement between the Israeli government and the Philippine government to regulate the employment of Filipino workers in the nursing sector, without brokerage fees.
The Interior Minister announced: Only thus can we supervise the manner of employment and ensure that the rights of the caregivers and their families are preserved, as well as the rights of the workers.
We are waiting to receive the signed agreement for the members of our group.
הסכם חדש - בוטלו דמי התיווך
כעת נמסר לנו כי שר הפנים הישראלי, אריה דרעי, ונשיא הפיליפינים, רודריגו דוטרטה, חתמו היום על הסכם בילאטרלי בין ממשלת ישראל לממשלת הפיליפינים להסדרת העסקת עובדים מהפיליפינים בענף הסיעוד, ללא דמי תיווך.
שר הפנים הודיע: רק כך נוכל לפקח על אופן ההעסקה ולוודא כי זכויות הסיעודיים ובני משפחותיהם נשמרות וכן זכויות העובדים.
אנו ממתינים לקבל את ההסכם החתום לרווחת החברים בקבוצה שלנו.

ביקור ראשון נשיא הפיליפינים - הסכם היסטורי בתחום הסיעוד
לראשונה מאז כינון היחסים הדיפלומטיים בין ישראל לפיליפינים נחת הערב נשיא פיליפיני ראשון בישראל.
במהלך הביקור בישראל צפוי להיחתם הסכם היסטורי בתחום הסיעוד, שהמגעים לחתימה עליו נמשכו כמה שנים.
מדובר בהסכם שיבטל את העמלה בגובה 12,000 דולר שכל עובד פיליפיני המגיע לישראל נדרש לשלם על מנת לעבוד בסיעוד. לפי ההסכם החדש, כל עובד יידרש לממן רק את הגעתו שלו ועמלה מצומצמת בגובה 800 דולר.
First Visit of Philippine President in Israel - Historic Agreement for Nursing Workers
For the first time since the establishment of diplomatic relations between Israel and the Philippines, the Philippine president landed in Israel.
During the visit to Israel, a historic nursing agreement is expected to be signed.

איך מוכיחים מרכז חיים בישראל?
אדם שמבקש אזרחות או תושבות ישראלית או לבצע הגירה לישראל, צריך להוכיח שהוא אכן מתגורר בישראל.
ניתן להציג מסמכים (חוזה שכירות, ארנונה, מקום עבודה, לימודים). הבעיה קשה יותר לאדם ללא מעמד חוקי בישראל או לבת זוג של ישראלי, שהחוזה וכל המסמכים מופיעים על שמו.

How do you prove a center of life in Israel?
A person who wishes to obtain Israeli citizenship or Israeli residency or to immigrate to Israel, must prove that he/she does indeed live in Israel.
Documents can be presented (rental contract, property tax, work place, studies). The problem is more difficult for a person without legal status in Israel or for a spouse of an Israeli, whose contract and all the documents appear in his name.
In appropriate cases, valid legal documents may be made to regulate the status of a foreign spouse (marriage agreement, will) and affidavits of relevant parties. It is important that these documents be drafted by an immigration attorney to Israel, who is familiar with the requirements of the Ministry of the Interior.
An interview (hearing) at the Ministry of the Interior - this is a critical stage. It's very important to prepare for it in advance. This is a one-time opportunity to emphasize important issues, to show the representative who is the person behind the request, and to convince the truth of the request and justification to grant a status in Israel. An immigration lawyer is authorized to be present at a hearing.
From our experience, presenting correct and well drafted documents, proper impressions at the interview and a wise presentation of the facts, can lead to obtaining status in Israel (citizenship or residency) even in the most difficult and problematic cases.

משרד הפנים מכיר בבני זוג בני אותו מין
חוק הפונדקאות העלה לאחרונה טרוניות רבות. מדובר בבעיה לא פשוטה בישראל של המאה ה-21.
להבדיל, משרד הפנים הכיר לפני מספר שנים בזוגיות בין בני אותו מין לקבלת מעמד בישראל.
הנוהל להכרה בזוגיות מורכב, אבל אינו מציב לכאורה קשיים נוספים, על המורכבות הקיימת ממילא לגבי זוג "רגילים". רשות האוכלוסין אינה מקלה על ההכרה בזוגיות, ועומדת על קיום דרישות רבות ובחינת הקשר לאורך מספר שנים.

במידה ומשרד הפנים לא מכיר בזוגיות, פתוחה הדרך לעתור לבית המשפט.
The Ministry of the Interior recognizes spouses of the same gender
Surrogacy law has recently raised many grievances. This is not a simple problem in Israel of the 21st century.
In contrast, several years ago, the Ministry of the Interior recognized same-sex couples for status in Israel.
The procedure for recognition of a relationship is complex, but it does not pose any additional difficulties, as it does with regard to the "ordinary" couple.
The Population Authority does not facilitate recognition of the relationship, and insists on fulfilling many demands and examining the relationship over several years.
The relevant procedure recognizes in principle the LGBT relationship.
If the Ministry of the Interior does not recognize marriage, it is possible to appeal to the court.

האם אפשר לקבל כיום אזרחות ישראלית לבן/בת זוג?
בהחלט. מדובר בתהליך מורכב ולא קצר, אבל אפשרי.
הקריטריונים לקבלת אזרחות ישראלית נקבעו בחוקים של הכנסת, פרוצדורות של רשות האוכלוסין, ופסיקת בתי המשפט.
לא תמיד מדובר במאפיינים חדים וברורים. חשוב לדעת כיצד "לבנות את התיק" להציג את העובדות על מנת לשכנע את נציגי משרד הפנים.
מה עושים אם משרד הפנים מסרב לבקשה? אפשר לפנות לערכאות משפטיות, אבל מדובר באפשרות קשה יותר. לכן רצוי להיעזר במומחה ותיק מהפנייה הראשונה למשרד הפנים.
Is it possible to obtain Israeli citizenship for your spouse today?
Certainly. This is a long and complicated process, but a possible one.
The criteria for obtaining Israeli citizenship were set forth in the laws of the Knesset, the procedures of the Population Authority, and the rulings of the courts.
These are not always clear and sharp features. It is important to know how to "build the case" how to present the facts, in order to convince the representatives of the Interior Ministry.
What can we do when the Ministry of the Interior rejects the request? It is possible to apply to the courts, but this is a more difficult option.
Therefore, it is advisable to consult an expert with seniority from the first request to the Ministry of the Interior.

אילו נימוקים אפשר להציג על מנת לשכנע את רשות האוכלוסין לתת מעמד הומניטרי בישראל?
למשל, אשה שבאה לעבוד בישראל, והשאירה את הבן שלה אצל משפחתה בפיליפינים. אחרי כמה שנים הבן הצטרף אליה בישראל, ומאז הם חיים יחד.
בתי המשפט בישראל בודקים כמה שנים נמשך הנתק בין האמא לבן, מה היו הנימוקים לנתק, בן כמה היה הבן כשהגיע לישראל (קטין? בגיר?) וכמה שנים הם מתגוררים יחד בישראל.
What reasons can be presented in order to convince the Population Authority to grant humanitarian status in Israel?
For example, a woman who came to work in Israel, and left her son with her family in the Philippines. After a few years the son joined her in Israel, and since then they have been living together.
The courts in Israel examine how long the separation between the mother and the son lasted, what were the reasons, how old was the son when he came to Israel (A minor or an adult) and how many years they have lived together in Israel.
