Are prenuptial or co - habitation agreements only for the wealthy?
Many couples believe that a financial agreement is only necessary where one partner has substantial wealth. However, this isn’t the case as, an apartment, a small amount of personal savings or a contribution from parents towards a home can raise important issues in the event of separation or divorce.
What happens if one partner contributes most of the consideration for the family home or already has an apartment before the marriage, but both pay the mortgage? How should money invested in a property owned before the marriage be treated? What arrangements should apply if the relationship ends?
A carefully drafted financial agreement can address these matters in advance, distinguishing between assets that are to remain separate and those the couple intends to share. An agreement must reflect the couple’s specific situation, rather than rely on a standard template that may overlook important details.
In Israel, the formal requirements matter as much as the wording. The appropriate approval or authentication procedure depends on the couple’s circumstances and whether the agreement is made before or during marriage. Simply signing a document between yourselves may not be sufficient.
It is advisable to obtain competent legal advice and discuss financial expectations before a disagreement arises. Addressing these questions openly and signing a prenuptial or cohabitation agreement can provide both partners with greater clarity as they build their life together.
