I am pleased to share that my latest article, "Managing a family business upon loss of legal capacity in Israel: enduring power of attorney or a trust?", has been published in The International Family Offices Journal (June 2026, Vol. 10, Issue 4).

The article examines the strategic and legal frameworks for maintaining family business operations when a key stakeholder loses legal capacity. By analyzing the interplay between Enduring Powers of Attorney (OPA) and Trust structures under Israeli law, it highlights the distinct corporate and statutory challenges faced by sole proprietors, partners, shareholders, and directors—offering practical guidance on integrating these instruments into a comprehensive succession plan.

ערב עיון: נאמנויות, 16/06/2026

אני שמחה לשתף בתמונות מערב העיון המקצועי בנושא נאמנויות, שהתקיים השבוע (16.6) באשכול פיס בכפר סבא, מטעם ועדת הקשר כפר סבא של מחוז מרכז בלשכת עורכי הדין.

האירוע, שהתמקד בנאמנויות במשפחה, נועד להעלות את רמת המקצועיות של חברי המחוז בתחום הנאמנויות, ולחשוף אותם לממשקים של הנאמנות עם סוגיות הנוגעות לחלוקת הרכוש הזוגי ולאובדן כשרות משפטית. במסגרת ערב העיון, העברתי הרצאה בנושא "נאמנויות ככלי להעברה בין-דורית במשפחה" והשתתפתי בפאנל המרכזי יחד עם כבוד הרשמת, ציפי סולומון דרמר, מנהלת מערך הרשם לענייני ירושה והאפוטרופוס הכללי במשרד המשפטים.

קיומו של הערב הזה, בפרט לאחר שנדחה ממועדו המקורי עקב מבצע "שאגת הארי", לא היה מתאפשר ללא השקעת זמן ומרץ רב של שותפים יקרים לדרך.

אחרי המתנה לא מבוטלת, אני שמחה שערב העיון של ועדת הקשר כפר סבא בנושא נאמנויות יוצא לדרך במועד החדש: 16/06/2026.

ערב העיון יתמקד בנאמנויות במשפחה ויתייחס לשלוש סוגיות מרכזיות:
☑️העברה לדור הבא: אני ארצה על השימוש בנאמנות ככלי אסטרטגי להעברת הון, ואיך משתמשים בה כדי לשמור על ההון המשפחתי ועל שלמות המשפחה.
☑️בין בני זוג: עו"ד נטע מרום מעוז תדבר על הנאמנות בתוך המארג העדין של הסדרי יחסי ממון – היכן הכלי הזה פוגש את המציאות הזוגית והרכושית.

בפרק הזה של "מדברים מספרים" התארחתי אצל עמית והגר כדי לדבר על איך אפשר לשמור על ההון המשפחתי לאורך זמן ולהראות שתכנון נכון חשוב לכל אחד.

בשיחה זו, דיברנו על כל שצוואה לא תמיד מספיקה ולעתים יש צורך בכלים נוספים, דיברנו על מהי הנאמנות ואיך ניתן להשתמש בה כדי לתכנן את ההון המשפחתי קדימה, דיברנו על "המשפחה הגולבאלית" - משפחה שבה גם בני משפחה וגם נכסים פזורים על פני כמה מדינות וגם דיברנו על ייפוי כוח מתמשך והסכמי ממון ככלי לניהול סיכונים.

בניית עושר דורשת אומץ, אבל שמירה עליו לדורות דורשת חוכמה וכלים משפטיים מתקדמים.
