Renting vs. Buying: The Decision Most Olim Face First
For many English-speaking Olim, the question of whether to rent or buy is one of the first major decisions they face after making the move, and sometimes even before it.

A few principles worth keeping in mind:

Buying tends to make sense when the buyer intends to stay long-term, has access to sufficient capital or financing, and is purchasing in a market where values are stable or likely to appreciate. Buying also provides security of tenure that renting simply does not offer in Israel.

Renting tends to make sense when the buyer is still uncertain about long-term plans, is new to Israel and still learning which communities feel like home, or does not yet have the financial resources to make a purchase comfortably. Renting provides flexibility, and flexibility has real value.

Neither option is without its challenges. Rental prices in many parts of the country have risen sharply, and tenants can face significant disruption at the end of each rental period. Property prices have climbed steeply over the past two decades.

What matters most in either case: the transaction is handled carefully, the documents are reviewed and understood, and the rights and obligations of all parties are clearly established in writing.

In the US, a title insurance policy provides after-the-fact protection if a title defect surfaces after closing. In Israel, that safety net does not exist.

Instead, the burden of verification falls entirely on the buyer. Due diligence is not optional. It is where your protection is built.

Thorough due diligence on an Israeli property should include:

Pulling a Tabu (Land Registry) extract to confirm the legal owner and check for any mortgages, liens, attachments, or easements registered against the property.

Understanding how the property is registered. If it's held through the Israel Land Authority rather than the Tabu, different documentation and procedures apply.

Verifying there are no outstanding municipal debts or charges on the property.

Reviewing the building's condo association (Vaad Bayit) records, including pending assessments or litigation.

Getting a physical inspection by a licensed engineer.

Checking municipality and planning authority records to confirm everything that was built was built legally. Unauthorized construction is a real issue in Israel, and buying a property with unpermitted additions can expose you to fines and even demolition orders.

If something surfaces during due diligence, knowing before signing is far better than finding out afterward.

How Payment Actually Works in an Israeli Property Transaction
Payment in Israeli real estate is not like handing over a check at closing. It follows a milestone-based installment schedule that spans the full timeline of the transaction.

A common structure:

An initial payment at signing.

One or more interim payments as specific conditions are satisfied (delivery of bank guarantees, clearance of title issues, etc.).

A final payment on or before the date of possession.

The exact structure depends on the transaction and is one of the most heavily negotiated elements of the purchase agreement.

If you're financing with a mortgage: Israeli banks generally finance a percentage of the property's value, with the loan-to-value ratio depending on whether it's a primary residence and your residency status. Mortgage approval takes time. In most cases, it should be in place before signing the agreement.

Transfer of possession typically occurs on the date specified in the contract and is linked to the final payment.

And registration of ownership at the Tabu is the formal legal close. This process can take several months after possession, which is exactly why the cautionary note registered at signing is so important.

Not all Israeli lawyers practice real estate law. And not all who do are equally familiar with the specific complexities that arise in Israeli transactions, particularly those involving foreign buyers, properties with complicated title histories, or newer development projects.

Israeli real estate law has its own terminology, its own procedural requirements, its own regulatory landscape, and its own traps.

A purchase agreement drafted without deep familiarity with this field, even one that looks like a legitimate contract, may be missing protections that are standard in well-drafted agreements, or may contain provisions that don't function as intended.

For English-speaking buyers especially, having a lawyer who operates fluently in both Hebrew and English is about more than translation. Everything in Writing. Always. Here's Why.
In Israeli real estate law, verbal agreements are very difficult to enforce.

In one case involving a property handover on Erev Yom Kippur, a significant water leak had emerged just before the transfer date. Faced with the circumstances, the seller offered to hand over the keys as planned and send their plumber to handle the water damage while the buyer was already living in the property.

That commitment was put in writing.

The moment the moving truck left the property, the phone rang. The seller's legal representative had contacted the buyer directly to inform her that the seller was no longer responsible for the leak. There would be no repair. As far as the other side was concerned, handover had happened and the matter was finished.

What changed the outcome: the written commitment.

Without it, the situation would have been a lot more complicated to deal with. With it, there was a clear basis for holding the seller to exactly what they had agreed to.

Whatever a seller agrees to fix, repair, or take responsibility for in an Israeli real estate transaction: get it in writing. Every time.
