High Court success in employment visa case

We recently represented a client in the High Court in a challenge to the refusal of an employment visa.

The Court quashed the Minister for Justice’s appeal decision, finding that the process was flawed — including a failure to properly consider evidence submitted, reliance on generic reasoning, and the application of requirements not set out in published guidance.

While immigration decisions involve discretion, the Court reaffirmed that decisions must still be made fairly and transparently.
