In Ireland, "civil restraining order" can refer to two different legal frameworks depending on your relationship with the person involved.
The laws recently expanded under the Criminal Justice (Miscellaneous Provisions) Act 2023, making it much easier to get protection from stalkers even if you have never been in a relationship with them.
1. Section 28 Civil Restraining Orders (New)
This is likely what you are looking for if the person is not a family member or former partner (e.g., a stalker, neighbor, or stranger).
* Who can apply: Anyone. There is no requirement for a pre-existing relationship.
* Purpose: To stop stalking or harassment that causes you distress or fear of violence.
* What it does: Orders the person to stop following, watching, or contacting you.
* Duration: Can last up to 5 years.
* Emergency Protection: You can apply for an Ex-Parte Order (urgent, temporary protection) that lasts up to 8 days while waiting for the full hearing.
* Cost: There is an €80 fee to apply, but no fee for the emergency order if the main application is already filed.
2. Domestic Violence Orders
If the person is a current or former spouse, partner, or family member, you apply for one of these under the Domestic Violence Act 2018:

3. How to Apply
The process for both types generally happens at your local District Court:
* Find your Court Office: Go to the District Court office in the area where you live or where the respondent lives.
* Fill out the Forms: Ask for the "Section 28 Civil Restraining Order" forms or "Domestic Violence Order" forms.
* See a Judge: In urgent cases, you can usually see a judge the same day (Ex-Parte) to get immediate temporary protection.
* Service: The Gardaí or the court office will ensure the other person is served with the summons.
* Full Hearing: You will attend a private hearing to explain your case. You can bring a friend, family member, or support worker for help.
