UPDATED NOTE ON DRAFT SCHEME TO REGULARISE UNDOCUMENTED MIGRANTS

The Department of Justice are proposing the following eligibility requirements:

- The principal applicant must have resided in the State without immigration permission continuously for a minimum of four years prior to applying under this Scheme
- For applications that include children, this residence criteria is reduced to three continuous prior residence in the State by the principal applicant
- The Department are not proposing to set any income requirements
- The Department propose to look at character and criminality considerations
- The Department propose that documentation to prove identity & residence in the State upon arrival will be required
- The Department are proposing that this scheme will be open for a specific timeframe – i.e. for approximately six months. There will be an online application process.

It is proposed that successful applicants will be awarded an immigration permission (stamp) which provides for unrestricted access to the labour market. It is not yet confirmed which stamp will be granted. The Department proposes that years of residence on this permission will be reckonable for the purposes of citizenship applications in the future.

The Department have confirmed that there will be a right to appeal, if an applicant receives a refusal decision.

It is important to note that this scheme has not yet been launched. It is envisaged that the scheme will be launched before the end of 2021.

NOTE ON DRAFT SCHEME TO REGULARISE UNDOCUMENTED MIGRANTS

Minister for Justice, Helen McEntee, has today announced her draft proposals for a scheme to regularise undocumented migrants in Ireland.

The terms of the scheme are subject to the consultation process which will take place with stakeholders. The Minister’s initial proposals envisage that eligible people would:

- Have a period of 4 years residence in the State without an immigration permission, or 3 years in the case of those with children;
- Be granted an immigration permission that allows for unrestricted access to the labour market; and
- Have years of residence with that permission reckonable for the purposes of pursing citizenship by way of naturalisation

It is envisaged that this scheme will be launched before the end of 2021. It will operate under the Executive Powers of the Minister for Justice on an administrative basis and will be time limited. It is anticipated that it will open for approximately six months. When assessing applications, regard will be given to the character and conduct of an individual.

NEW VISA /PRECLEARANCE APPLICATIONS WILL NOT BE ACCEPTED UNTIL 5TH MAY AT EARLIEST

INIS have recently extended the effect of Notice of 29th January 2021 “COVID 19 Visa arrangements,” available at http://www.inis.gov.ie/en/INIS/Pages/visas-updates.

This Notice has been effective since 29th January 2021 and applies to all countries.

The most recent update on 6th April extends this cessation to “at least 5th May.”

Certain Priority/Emergency cases will continue to be processed including;
- workers/self employed persons exercising critical occupations eg healthcare
- transport workers
- patients travelling for imperative medical reasons
- persons travelling for imperative family or business reasons

The recent update gives some more guidance on the meaning of “imperative family reasons” confirming that these cases are “largely confined to emergency cases that may arise in a family situation” and confirming that this does not include wanting to attend a birth/wedding/milestone birthday.
