What happens when co-owners or beneficiaries can’t agree????

This happens far more often than people realise, but it can be minimised with proper planning. In Connolly v Connolly [2026] IEHC 10, siblings all agreed the property should be sold…They just couldn’t agree how.

Some wanted a developer option. Others wanted an open-market sale. The High Court stepped in and ordered a sale; making it clear that co-owners shouldn’t be forced into speculative or risky arrangements.

Disputes like this are common with inherited property, but clear succession planning, agreed sale mechanisms, and proper advice in advance can prevent years of delay, cost and family fallout.

Three things to know about Probate.
1️⃣ It’s much quicker than it used to be. Most Grants now issue within 12 months of the date of death.
2️⃣ Executors need a lot of information. The sooner it’s gathered, the smoother and quicker the process.
3️⃣ The Grant of Probate allows you to collect the estate assets. It’s often several weeks after that before distribution can take place.Probate isn’t instant, but with the right advice, it doesn’t need to be overwhelming.

Since 2024, renting out your family home while you’re in a nursing home does not increase your Fair Deal contribution.That’s a big change ……but it doesn’t mean there’s no tax, and it doesn’t remove the need for proper succession planning.Fair Deal, income tax, wills, and family dynamics are separate systems and they need to be planned together.

An important update for unmarried couples 💛
For many years, long-term, committed but unmarried partners were left at a disadvantage when a loved one passed away.
What was previously known as the Widow’s Pension, is now the Bereaved Partner’s Contributory Pension, and it has been extended to include qualified cohabitees.
👉 If your partner died on or before 21 July 2025, To benefit from backdated payments, applications need to be made by 21 January 2026.
👉 If eligible, payments may be backdated to January 2024.
👉 Conditions apply, and eligibility depends on individual circumstances.
This is a welcome and long-overdue change. If you think this might apply to you, don’t assume you’re not entitled — contact your local Social Welfare office or visit gov.ie for more information.

Emma Gilhooly, principal solicitor at Larney Gilhooly Lynn Solicitors, has received an Award from STEP Ireland for succession planning, recognising outstanding academic achievement in the STEP Diploma in Trust and Estate Planning. The award was presented in December 2025 at the Law Society, Blackhall Place, Dublin.

This recognition reflects a nationally recognised standard of expertise in succession and private client planning, and places Emma among a small number of solicitors in Ireland with advanced specialist training in this area.

Succession planning is often underestimated. At this level, it involves careful analysis of family circumstances, assets, tax exposure and future risks; including family businesses, land, blended families, ageing parents and incapacity planning. When done properly, it can prevent uncertainty, conflict and unnecessary cost for families in the future.

Our work focuses on structured, forward looking planning; not simply drafting documents, but designing arrangements that support families and businesses over the long term.
