A will made years ago can still be legally valid and no longer say what you actually want.

Marriage is the clearest example. Under Irish law, getting married cancels an earlier will unless it was made with that marriage already in mind. Many people never realise the old will stopped applying that day.

Separation is different. A separated spouse's will stays valid until it is formally changed, so outdated instructions can remain in place. A new child, or the death of someone named in the will, can leave gaps too.

A buyer's solicitor will ask whether the extension had planning permission, and whether that is backed up by a Certificate of Compliance from an architect or engineer. Knowing about the work is not the same as having it documented.

Without that certificate, a bank's solicitor may hold up the funds, and closing can stall for weeks while it gets sorted.

Checking the planning file before going to market, not after a buyer is found, avoids that delay.

The house has had the same extension for over a decade. Most people assume that settles things once contracts are signed.

It does not always work that way. A buyer's solicitor will usually ask for proof the extension was built with permission, or falls under an exemption. If the file only covers the original house and nothing for the extension, that gap needs to be closed before closing can happen.

Sorting it often means getting a Certificate of Compliance from an architect or engineer, sometimes months after the sale is agreed.

The Garda Siochana Compensation Tribunal allows certain victims of violent crime to apply through the Minister for Justice rather than pursuing a civil claim against an individual. It has its own process and time limits, separate from a personal injury claim.

A will only takes effect after death. It says nothing about who can act if someone is still alive but no longer able to manage their own affairs.

That is where an enduring power of attorney matters. It is a separate document naming who can step in for financial or personal decisions if capacity is lost. Without one, family members often have to apply through the courts, which takes longer than most expect.

Having a will alone does not cover this gap.
