⚖️ A demand letter from a bank can feel final. It rarely is.

📩 We recently acted for a client who received a demand under a secured banking facility. Without consent, the bank had unilaterally waived interest our client was entitled to on a separate product, then treated it as a payment by way of set-off. We challenged this unconscionable approach, relying on established Hong Kong principles and applicable regulatory obligations on contractual fairness. ✅ The bank moved quickly to settle on terms favourable to our client.

🏛️ The same theme runs through Chang Pui Yin v Bank of Singapore, where the Court of Appeal refused to let a bank hide behind its own fine print, applying the Unconscionable Contracts Ordinance (Cap. 458) and the Control of Exemption Clauses Ordinance (Cap. 71).

💪 A large opponent does not always get its way, and the opening letter is rarely the end of the story. If a demand lands on your desk, do not panic and do not sign straight away. ⏳ The sooner you take advice, the more options you keep.
