👶⚖️ Reproductive technology has advanced rapidly, but has Hong Kong law kept pace?

Our Senior Partner Gordon Oldham and Consultant Helena Hu have published a new article in the August issue of Hong Kong Lawyer Journal, “Reproductive Technology in Hong Kong - Legal Framework, Ethics and Emerging Judicial Trends.”

The article explores Hong Kong’s evolving approach to IVF, surrogacy and legal parenthood, including a selection of recent judicial developments where the courts have had to balance existing legislation with one overriding consideration - the lifelong welfare and best interests of the child.

The article also looks at the growing gap between Hong Kong’s existing regulatory framework and developments in reproductive technology, family structures and judicial thinking.

We took some time away from our desks for an Aromatherapy Workshop focused on improving sleep quality, as part of our ongoing OLN Wellness Programme.

💜 We learned how different essential oils can help us relax, reduce stress and support better sleep. Everyone had a chance to explore different scents, choose their favourites and create a personalised massage oil blend to take home.

The session ended with some simple massage techniques and mindfulness - a relaxing way to spend time together and pick up a few useful tips along the way.

📌 Statutory Re-Domiciliation: Non-HK family offices can seamlessly relocate to Hong Kong while fully retaining their legal identity and assets, with no stamp duty triggered by the transfer.

📌 0% Profits Tax Concession: Qualifying Family-owned Investment Holding Vehicles (FIHVs) with a minimum asset value of HK$240 million can enjoy a 0% profits tax rate, subject to meeting local operational requirements.

📌 The Proposed 2026 Reform: Introduced on 12 June 2026, the new Bill proposes to further enhance Hong Kong's competitiveness by: ✅ Expanding the 0% tax concession to cover digital assets, gold, private credit, and carbon credits. ✅ Removing the 5% incidental threshold, granting greater flexibility in corporate treasury and cash management. ✅ Broadening eligible fund structures to include certain "fund-of-one" setups.

As the regulatory landscape becomes more sophisticated, proactive structuring remains vital to navigating anti-avoidance measures and securing long-term tax certainty.
