Part 2 of our Renters’ Rights Act 2025 Series explores the reformed Section 8 framework.
With Section 21 abolished, Section 8 of the Housing Act 1988 becomes the principal route to recovering possession.

The Renters’ Rights Act 2025 significantly reshapes the grounds for possession, including:

• Ground 1A: possession where the landlord intends to sell
• Ground 7A: serious anti-social or criminal behaviour
• Ground 8: serious rent arrears
• Discretionary grounds involving judicial oversight #

The new framework seeks to preserve landlords’ rights to recover possession, while protecting tenants from arbitrary eviction.

However, it also introduces greater complexity. Success under the new regime depends on accurate alignment of facts with the statutory ground, compliance with preconditions and robust evidence.

From April 2027, changes to the treatment of pensions could bring more Estates within the scope of Inheritance Tax.

Key takeaway from Part 1 of our Renters’ Rights Act 2025 Series: possession law is moving from flexibility to accountability.

Under the previous Section 21 regime, landlords could recover possession without giving a reason, provided the procedural requirements were met.

Under the new regime, landlords must rely on statutory grounds under Section 8 and prove those grounds on the balance of probabilities.

This means landlords will need to think carefully about evidence, record-keeping and the legal basis for any future possession claim.

For tenants, the abolition of Section 21 means tenancies can no longer be ended simply because a landlord chooses to recover possession. However, tenants remain subject to eviction where statutory grounds are established, particularly in cases involving serious rent arrears, criminal or anti-social behaviour.

Thank you to Merriman Grange Care Home for welcoming our Private Client team yesterday for the first of our regular legal drop-in sessions.

It was a pleasure for Lauren Barker to spend time with residents, families and members of the local community in such a warm and welcoming setting.

These quarterly sessions are designed to give people the opportunity to talk through legal questions in an approachable environment, with our visiting lawyers covering areas including Wills, Lasting Powers of Attorney and Estate Administration/Probate.

We look forward to returning for the next session in January.
