Kate explained that she is also facing legal difficulties that have stopped her from accessing Derek’s bank or credit card accounts, the couple’s joint savings account and she hasn’t been able to refinance their mortgage due to Derek being the account holder and her not having power of attorney.

Wills witnessed by video during the pandemic to be legalised

New rules will allow a will to be witnessed using
video conferencing software, such as Zoom, Facetime and Skype.

The new rules will be backdated to 31 January 2020
-which was the date of the first confirmed coronavirus case in the UK.

The government has said the use of video technology
should remain a last resort, but it may be useful in some circumstances.

The Government is introducing legislation to allow people to use video-conferencing technology for the witnessing of wills being made.

If a married person with children dies without leaving a will under the intestacy rules the surviving spouse receives:
1. a set sum presently of £250K but from 6th February it is increasing to £270K.
2. household contents, clothing, any cars and
3. half of everything else
with the other half of everything else being divided between the children.
If that person is in a relationship, but not married, under the intestacy rules everything goes to the children.

Overdue update increases the amount spouses and civil partners are entitled to if their partner dies without a will.
