We often see signs that say something along the lines of “By entering this playground you acknowledge that the owners are not liable from any injury or losses suffered while using the equipment”. Do these signs absolve the playground owners of any responsibility? Not if they can be shown to be negligent.

Section 2(1) of The Unfair Contract Terms Act 1977 states:

“A person cannot by reference to any contract term or to a notice given to persons generally or to particular persons exclude or restrict his liability for death or personal injury resulting from negligence.”

This provision is carried over into section 65(1) of The Consumer Rights Act 2015. So in the case of our playground example, signs saying that by entering you accept all the risk would be classed as an unfair contract and not stand up in Court if the owner had been negligent in some way such as not maintaining the equipment.

In a survey by the British Dental Association, 86% of dentists surveyed reported having to treat complications from dental work carried out abroad (so called Turkey teeth or dental tourism). Often remedial treatment will not be covered by the NHS and 1 in 5 of the survey respondents said that the corrective treatment cost the patient over £5,000.

5 Common divorce mistakes:

1. Failing to Sever financial ties
Many people assume that once the Conditional Order (formerly the Decree Nisi) is received, that they are financially free from their ex-spouse. That is not the case. You need to apply for a financial order or a clean break order to ensure any financial obligations are cut. If you don’t do this it could mean that your ex could make a claim against you in the future.

2. Overlooking Pensions
We often see spouses, especially women, are often too quick to take the family home in a settlement. Picking property over pension wealth can be very costly especially to a spouse who has sacrificed work to raise children. This is partly down to a lack of understanding of the value of the pension but also a lack of awareness of a person’s right to a spouse’s pension. After property it is the second largest financial asset, and it is vital to ensure that both spouses have savings for life.

3. Involving Children in your disputes
It is crucial to protect your children from emotional harm and not involve them in any arguments or discussions designed to influence them into taking a side

Determining the level of compensation in legal cases is something we often get asked about. Age is often a starting point. If someone is killed at age 35 then they potentially had another 32 years of working ahead of them. In other words, 32 years of earnings have been lost. The Courts take into account any children and joint expenses between a couple when determining compensation. For example, where no children are involved it is assumed that any income would be divided equally between the surviving partner, their deceased spouse, and joint expenses. Any compensation claim is therefore for the lost 2/3 of earnings.

With any compensation claim, the company being sued will be attempt to minimise the amount of damages they have to pay. Having an experienced legal team is critical to ensuring you and your family receive the maximum amount of compensation to start rebuilding your lives.

It's tempting to try to write a Will yourself using one of those DIY kits from the High Street, or to choose a "Will Writer" over a solicitor. On Sunday 26/05/2024, Robin Torr our Senior Partner will be dusting off his running shoes to take part in the AJ Bell Great Manchester Run 2024 to raise money for The Lewy Body Society.

Why? The answer is simple: Robin's mum suffers with Lewy Body Dementia. Despite this being the second most common type of dementia, it is the one nobody has heard of. Thanks to the efforts of The Lewy Body Society this is changing and he is proud to raise money to support them on their journey.

The last time Robin ran the Manchester 10k was in 2015 (raising money for the British Heart Foundation (which is another charity close to his heart (no pun intended)) when he completed it in a palindromic time of 50:05. If he could match (or beat) that time, he’d be really chuffed.

Robin has set a fundraising target of £400.00 but is hoping to smash that.
