🚨 Police can now seize your vehicle without giving you a warning first.

Since 29th June 2026, police no longer have to issue a Section 59 warning before potentially seizing a vehicle where the legal requirements are met.

And since 22nd July 2026, the period before certain seized vehicles can potentially be disposed of has been reduced from 14 days to just 7.

So, what does this mean for drivers and when can police actually use these powers?

We explain the new rules in our latest blog πŸ‘‡

πŸš” Can the police take your driving licence away at the roadside?

Despite recent headlines, the answer is usually no. In most motoring cases, only a court can disqualify a driver. However, proposed changes to drink and drug driving laws could change that.

Our latest blog explains:

βœ”οΈ The current law
βœ”οΈ What changes are being proposed
βœ”οΈ Why the proposals are controversial
βœ”οΈ What it could mean for motorists

"I didn't provide a specimen, so I have no defence."

This is one of the biggest misconceptions we hear.

A charge of failing to provide a specimen is a serious allegation, but it does not automatically mean you will be convicted.

The prosecution must prove that the correct legal procedure was followed and in some cases there may be a valid reasonable excuse for failing to provide a breath, blood or urine sample.

Our latest blog explores:

πŸ‘‰ What the prosecution must prove.
πŸ‘‰ What amounts to a reasonable excuse.
πŸ‘‰ How medical conditions, mental health and needle phobia can affect a case.
πŸ‘‰ Why custody footage and police station procedures are often crucial.
πŸ‘‰ Why obtaining legal advice early can make all the difference.

Every case turns on its own facts, and careful analysis of the evidence is essential.

Facing a 6 month driving ban after reaching 12 penalty points? You may have more options than you think.

If you accumulate 12 or more penalty points within 3 years, the court will usually impose a minimum 6 month driving disqualification under the totting up rules.

However, in some cases, it may be possible to avoid or reduce that ban by successfully advancing an exceptional hardship argument.

In our latest blog, we explain:

βœ”οΈ What a totting up disqualification is
βœ”οΈ What "exceptional hardship" actually means
βœ”οΈ The evidence the court expects to see
βœ”οΈ Why recent guidance has raised the standard required
βœ”οΈ How early specialist legal advice can improve your chances of success

Exceptional hardship cases are often less straightforward than people expect. A well-prepared argument, supported by the right evidence and presented effectively, can make a significant difference to the outcome.

Charged with drink driving? A driving ban isn't always inevitable.

Many people assume that being charged with drink driving automatically means losing their licence. While a disqualification is the usual starting point, there are some situations where it may be possible to reduce or even avoid a ban.

Our latest blog explains:

βœ”οΈ The minimum penalties for drink driving
βœ”οΈ When a ban may be reduced
βœ”οΈ Potential legal defences
βœ”οΈ What "special reasons" means
βœ”οΈ How a basis of plea can sometimes affect the outcome
βœ”οΈ Why obtaining specialist legal advice early can make a significant difference

Every case is different, and the right legal strategy depends on the specific circumstances. If you've been charged with a drink driving offence, understanding your options from the outset is essential.
