Judicial review is a very important legal tool that we have the privilege of having in this country. It allows us to exercise our power on unruly decisions made by public bodies. It promotes the Rule of Law!
There are four main grounds for judicial review; Illegality, Procedural Impropriety, Irrationality, and Proportionality. These are outlined under the Public Law Act 2000.
We can bring a claim for judicial review under the Judicial Review Procedure Act 1991.
To be eligible to bring a claim for judicial review, you must have a sufficient interest to the case. You must be directly connected to the matter, or on a whole show that there is public importance and urgency in the matter.
A few small examples would be your child being denied a place in a local school based on whatever reason. Another individual example would be, the council approving planning permission without consulting nearby residents.
