Living together for many years does not give unmarried couples the same inheritance rights as spouses or civil partners.

If one partner dies without a valid will, the surviving partner does not automatically inherit under the intestacy rules, regardless of how long they have lived together.

Depending on the circumstances, a surviving cohabiting partner may be able to make a claim against the estate under the Inheritance (Provision for Family and Dependants) Act 1975, but eligibility requirements and strict time limits can apply.

Being a child of the person who died does not automatically mean you are entitled to a particular share of their estate. However, children are among those who may be able to make a claim under the Inheritance (Provision for Family and Dependants) Act 1975 if reasonable financial provision has not been made for them.

Claims can involve minor children, adult children and, in some circumstances, people who were treated as a child of the family.

The court will consider the individual circumstances of the case, including the claimant's financial needs and resources and other relevant factors.

The cost of hiring a solicitor to handle probate varies a lot — it depends largely on the estate’s size, complexity and what you expect the solicitor to do.

For simple estates, a solicitor might quote a fixed fee. For larger or more complex estates they often charge based on a percentage of the estate value — typically about 1% to 5% for full administration.

➡️ The work is split into stages: applying for the Grant of Probate, then administering the estate (collecting assets, paying debts, distributing to beneficiaries).
➡️ On top of the solicitor’s fee, there will be other costs or “disbursements” such as probate application fees, valuations, and searches.
