Can you make your ex pay your Family Court legal costs?

It’s a question that often arises when family proceedings become lengthy or difficult.

Unlike some other forms of litigation, there isn’t a straightforward rule that the unsuccessful party will pay the other person’s costs.

In proceedings concerning children, costs orders are unusual, although the court retains discretion to make one in appropriate circumstances.

Financial remedy proceedings have their own rules. The general position is that each party bears their own costs, but the court can make a different order where a party’s conduct justifies it.

Every case is different, so obtaining advice on your individual circumstances is important.

🐾 Meet Pegi, our (unofficially official) office dog!

It’s International Dog Day, so we thought it was about time we introduced a very important member of the Avery Naylor team. ❤️

Pegi might technically belong to one of our directors, but she’s been firmly adopted into the Avery Naylor family and has become our resident office dog.

She brings plenty of joy to the office, provides a welcome distraction on the more stressful afternoons and, as you can see, looks rather at home in Avery Naylor red! ❤️🐶

Because families come in all shapes and sizes… and sometimes they have four paws. 🐾

Thinking about recording a conversation with your ex?

When communication is difficult, it can be tempting to press record, particularly if you’re worried about what is being said or want to keep a record of what’s happening.

But will a Family Court actually consider a secret recording?

The answer isn’t always straightforward.

Covert recordings can sometimes be used as evidence, but whether they are helpful will depend on the individual circumstances. And when children are involved, particular care is needed.

What happens if someone keeps making applications to the Family Court?

Sometimes circumstances change and there is a genuine need for a parent to return to court.

But repeated or unreasonable applications can place considerable strain on families and, in some circumstances, may themselves cause harm.

The Family Court has the power to make a Section 91(14) Order, requiring a person to obtain the court’s permission before making certain further applications under the Children Act 1989.

These orders are intended to act as a protective filter rather than an absolute bar to future applications.

Attending court can feel overwhelming, particularly where proceedings involve domestic abuse, coercive behaviour or significant conflict between the parties.

The Family Court can put special measures in place to help individuals participate effectively and safely in proceedings. These arrangements are designed to reduce distress and ensure that everyone is able to engage fairly with the court process.

Special measures may include separate waiting areas, giving evidence by video link, the use of screens in the courtroom and protection from direct questioning in certain circumstances.
