Our Director, Ashley Davies, and Solicitor, Olivia Budge, recently acted for the successful Respondent in the Court of Appeal case Evans v Swansea Building Society.

Appellants had been given permission to appeal an earlier order of the High Court, by which they had been refused an oral hearing to reconsider the dismissal of an earlier permission to appeal application. 🗒️

The Court of Appeal concluded (with the consent of the Respondent) that the appeal should be allowed and there was an entitlement to an oral reconsideration of the earlier dismissed application. The three Lord Justices of the Court of Appeal then proceeded to deal with that oral reconsideration and with various other applications made by the Appellants, including an application for an injunction restraining the sale of the property that is the subject of the proceedings.

Counsel Rory Forsyth of Maitland Chambers, instructed by Ashley and Olivia, successfully opposed all such applications on behalf of the Respondent, with the judgment providing useful guidance for similar cases in the future. 👏
