We are already seeing increasing scrutiny around vulnerability in possession, debt recovery and enforcement matters. In our experience, landlords who maintain clear records, engage with tenants early and obtain legal advice before issues escalate are generally better placed to manage disputes and avoid costly delays.
The new ECB vulnerability standards do not prevent landlords from recovering possession or pursuing debt. However, they are likely to increase scrutiny of enforcement decisions, place greater emphasis on record keeping and early engagement, and may lead to delays where vulnerabilities are identified. Landlords who review their processes now will be in a stronger position when the new regime takes full effect in January 2027.
