✅ Application Granted Outside the Immigration Rules – We successfully secured leave for a child under 18, relying on paragraph CHI 4.3(b) following compelling evidence of domestic violence and exceptional circumstances.

COURT OF APPEAL SUCCESS | Ward v Donnellan [2026] EWCA Civ 729

We are proud to share that Awan Legal acted for the successful Appellants in the Court of Appeal case of Ward v Donnellan, a significant decision that provides important guidance on how courts should approach costs in multi-claim litigation.

The Court of Appeal overturned a costs order arising from lengthy and complex proceedings involving:
✔️ An unsuccessful partnership claim
✔️ A successful Part 20 beneficial ownership claim concerning leasehold interests
✔️ An associated possession claim
The judgment provides valuable clarification on the approach to costs where parties have achieved mixed outcomes across different aspects of a case.
