👨‍👩‍👧‍👦 Planning ahead for the October half-term

For separated parents, school holidays can sometimes raise questions around childcare, travel and how time with children will be shared.

With October half-term approaching, agreeing arrangements early can help reduce uncertainty and make the break easier for everyone involved.

If parents are finding it difficult to reach an agreement, our Family Law team can provide clear, practical advice on child arrangements and help you understand the options available.

At Walker Foster, we always encourage an approach that keeps the needs and wellbeing of the children at the centre of discussions.

Planning ahead can help make sure trusted people are able to support you if you become unable to make certain decisions for yourself.

If someone loses mental capacity without a valid Lasting Power of Attorney in place, their family does not automatically have the legal authority to manage all their affairs or make decisions on their behalf.

This may mean:

1️⃣ Bank accounts and finances cannot automatically be managed by relatives
2️⃣ Property may be difficult to sell or maintain
3️⃣ Family members may have limited authority over health and care decisions
4️⃣ An application may need to be made to the Court of Protection
5️⃣ The Court may appoint a deputy to make specific decisions
6️⃣ The process may involve court fees, ongoing responsibilities and additional delay
7️⃣ The person appointed may not be who you would have chosen yourself

A deputy’s authority is determined by the Court of Protection and may be limited to particular financial, property, health or welfare decisions.

Putting LPAs in place while you have mental capacity allows you to choose who you trust to act for you and record how you would like decisions to be made.

Walker Foster can help you prepare Property and Financial Affairs and Health and Welfare LPAs with friendly, clear and reliable advice, helping you and your family plan for the future with greater peace of mind.
