Thinking about chasing a debt through the courts? Before you take action, it pays to understand what it will actually cost you.

Court fees for issuing a claim start at £35 for debts up to £300 and rise to 5% of the claim value for amounts between £10,000 and £200,000. On top of that, fixed recoverable solicitors costs range from £50 to £100 depending on the value of the debt.

The good news is that if your claim is successful, those costs are recoverable. But the key question to ask first is whether the debt justifies the process. For smaller amounts, litigation can end up costing more than you stand to recover.

Our latest article breaks down the numbers so you can make an informed decision before you commit.

By the time you are ready to instruct a solicitor to act on your behalf in your debt claim, it is beneficial and cost effective to ensure you have collected as much evidence as possible prior to your initial meeting. Our friendly and helpful Litigation team will help to make sense of the evidence you have collected, advise on the strengths and weaknesses of your claim, and provide you with an invaluable insight into the legal process. By the time your meeting has concluded, we intend to ensure that all of your queries have been answered and you have been provided with all of the necessary information to help decide your next course of action.

It is our aim to make the remainder of the process as stress free as possible. Our Litigation team will deal with matters on your behalf and keep you informed of any updates in your case. Should you wish to contact us, our expert and friendly team is ready to assist you. For more information contact Darnell Alexander-Connell on 01756 799000 or alternatively email at [email protected]

💡 Debt Recovery – Collecting evidence before instructing a solicitor 💷

By knowing which documents and information might be useful to a solicitor before attending the initial enquiry meeting will be beneficial in helping your instructed solicitor to understand your claim. Prior to the meeting it is essential to know:

❓Who you intend to bring the claim against; is this an individual or a company and do you have their contact details?

❓Do you have a written contract evidencing the debt? If so, your instructed solicitor will need to see this.

❓Have any invoices been issued? If so, your instructed solicitor will need to see these.

❓Have any payments been made or received to the other party, and can these be evidenced by way of bank statements? Again, these would be useful in assisting your instructed solicitor.

❓Has there been any relevant correspondence between you and the other party?

The above list is not exhaustive, but it is important to remember the more evidence you have to support your claim the more chance you have in being successful in your claim. Therefore, you should collate as much relevant information as possible to bring to any initial enquiry meeting.

If you are unsure what information is required prior to your meeting and require further information contact Darnell Alexander-Connell on 01756 799000 or alternatively email at [email protected]
