The Government has launched a long-awaited consultation on major proposed reforms affecting cohabiting couples and inheritance rights where a partner dies without a will.

These changes could have a significant impact on how cohabiting relationships are treated in law.

The proposals include:

✅ Greater financial protections for cohabitants when relationships end, with a clearer framework for financial claims on separation

✅ Stronger safeguards for domestic abuse survivors, including consideration of making pre- and post-nuptial agreements more legally binding

✅ A new definition of cohabitants as couples who have lived together for at least three years or share a child

✅ Updates to the law on intestacy and financial provision from a deceased partner’s estate

The consultation is now live, with an outcome expected on 14 August 2026.

We’re extremely pleased to share that Wake Smith has achieved double-digit growth in fee income for the first time, a 17% increase from last year.

Over the last 12 months, we have continued to invest heavily in our people, technology, processes and business development, as well as building our busy Private Client, Corporate, Residential Conveyancing and Commercial Property teams.

These investments have supported another exciting year for the firm, including achieving Gold Investors in People accreditation for the first time, welcoming a host of new clients, advising on some of the most high-profile commercial transactions in South Yorkshire, and receiving recognition through regional award wins and shortlistings.
