It’s been a busy week for SEND in the media.

The i Paper reported that the timeline for the Government’s response to its major consultation on reforming the SEND system, and for new legislation setting out those changes, could slip beyond autumn and potentially into the new year.

The Guardian reported on comments from the Institute for Government (IfG) thinktank suggesting that the Government’s plans to replace EHC plans with widespread support in mainstream schools could take longer to deliver than its 2030 timeline.

For SEND families, the prospect of delays to reform, alongside the ongoing challenges of securing the support children and young people are legally entitled to, may be familiar.

At IPSEA, we will keep working and campaigning for better accountability within the SEND system and for the protection of children and young people’s legal rights as part of SEND reform.

It is important to remember that, until and unless new legislation is passed, the law has not changed, and existing legal duties continue to apply.

REMINDER - until legislation actually changes, current SEND legislation continues to apply!

SEND reform proposals are not the law 📣

The Government is still considering feedback on its SEND reform consultations, and no new legislation has been passed. Yet IPSEA is hearing concerns that some schools and local authorities may already be acting as though proposed changes have come into force.

SEND Tribunal pilot for section I only appeals registered from 17 August 2026 📣

The SEND Tribunal is going to case manage appeals which are only about placement differently.

What you need to know for section I only appeals:

🔷 Hearing dates will not be included in the initial case directions sent out on registration

🔶 After the bundle deadline, the SEND Tribunal will respond to any SEND7 Request for change forms (earlier responses will only be in exceptional circumstances) and consider if the appeal is ready to be heard

🔷 If the appeal is ready to be heard, it will be listed for the next available hearing date and/or a JADR hearing

🔶 If the appeal is not ready at that point, the SEND Tribunal will set further directions. This may include a revised timetable or action relating to non-compliance.
