Legal terminology can sometimes make an already important matter feel unnecessarily complicated. At Abbey Law, clear communication is central to the way we work. Legal terms should be explained in language that clients can readily understand.

Here are five terms that frequently arise in our work:

Exchange of contracts

The stage at which a property transaction becomes legally binding. If either party withdraws after exchange, there may be significant financial and legal consequences.

Completion

The date on which the purchase money is transferred, ownership changes hands and the keys are usually released. Completion often takes place one or two weeks after exchange, although both can occur on the same day.

Grant of probate

A legal document confirming an executor’s authority to administer the estate of someone who has died. It is often required before substantial assets, including property, can be sold or transferred.

Without prejudice

A rule that can protect genuine settlement communications from being placed before the court as evidence of admissions. Merely marking correspondence “without prejudice” does not automatically give it that protection.

Independent legal advice

Advice provided by a solicitor acting solely in your interests. It is commonly required before signing documents such as guarantees, mortgages or agreements that may create significant legal obligations.

If correspondence from a solicitor, lender or court is unclear, Abbey Law can explain what it means, what is required and the relevant next steps—in plain English.

Asked to sign a Personal Guarantee?

Before signing, it is important to understand exactly what you are agreeing to. A personal guarantee can expose you to significant financial liability, and in some cases your liability may be uncapped. Independent legal advice helps ensure you fully understand the risks, your obligations, and the options available to you before committing.

At Abbey Law, we regularly advise individuals and business owners on personal guarantees, independent legal advice certificates, secured lending, and related matters.

📞 Contact Abbey Law for guidance if you have been asked to sign a personal guarantee.

Nearly half of people in England and Wales believe that couples who live together long enough acquire the same legal rights as married couples—but “common law marriage” has no legal status. On separation, cohabiting partners do not automatically have rights to maintenance, pensions, savings or a share of the family home, regardless of the length of the relationship or whether they have children. Although reform has been proposed, it is not currently law; protection therefore depends on appropriate documentation, including a declaration of trust, cohabitation agreement and valid will. If you live in St Albans or elsewhere in Hertfordshire and would like clarity regarding your legal position, contact Abbey Law on 01727 839162 or visit abbeylaw.org (https://abbeylaw.org). Business lease renewal rights are under review. The Law Commission has provisionally proposed retaining the current contracting-out model under the Landlord and Tenant Act 1954, while considering whether the short-lease exception should increase from six months to two years. Although no legal changes have yet taken effect, landlords and business tenants should establish whether their lease benefits from statutory renewal protection and keep all break dates and expiry dates under review. Abbey Law advises on lease renewals, new leases and contracting out. Call 01727 839162. Hertfordshire Solicitors

Earlier this week Abbey Law attended an informative morning at Stadium MK, hosted by Dragon Information Systems Limited in partnership with MK Dons.
James Hart’s session on cybersecurity in the real world was particularly relevant for law firms. Ransomware and phishing continue to pose a serious risk to conveyancing practices and the client funds we protect. Lionel Naidoo’s practical demonstration of how AI is already improving productivity and client service was also thought-provoking.
The day finished with a behind-the-scenes tour of the stadium, including the dugout and the players’ areas.
Thank you to Mike Dancy, Mark Davies and Fed Quiroz, and to the whole Dragon IS and MK Dons teams, for a well-organised and worthwhile event. It was also great to meet and exchange ideas with so many local business leaders.

Since 1 May, Section 21 has been abolished and assured tenancies continue until a statutory ground for possession is established. Sellers relying on Ground 1A must generally give four months’ notice, while further restrictions and substantial penalties may apply. For buy-to-let investors, purchasing with the tenant in situ may offer a smoother transaction and uninterrupted rental income; owner-occupiers should establish the possession timetable before making an offer. Abbey Law acts on tenanted sales and purchases🔑
