📝 Who are you trusting to write your Will?

A Will is one of the most important legal documents you’ll ever make, so it’s worth checking who is actually preparing it and what training, standards and protection sit behind them.

In England and Wales, Will writing is not currently a reserved legal activity. That means choosing someone with recognised professional standards and appropriate training is particularly important.

At Nene Legal, I’m proud to be a Full Member of The Society of Will Writers (MSWW).

Being a member isn’t simply about paying a membership fee and displaying a logo. The Society requires applicants to demonstrate proof of proficiency through recognised qualifications, relevant experience or, where appropriate, an entrance examination.

And the learning doesn’t stop once you become a member.

✅ A minimum of 24 hours of Continuing Professional Development (CPD) every year
✅ Ongoing professional training covering Wills, trusts, estate planning and related areas
✅ Minimum £2 million Professional Indemnity Insurance
✅ Adherence to the Society of Will Writers Code of Practice
✅ An annual compliance audit, including evidence of CPD and insurance
✅ Access to specialist technical support when more complicated situations arise
✅ A formal complaints procedure and professional standards framework

Why does all this matter?

Because estate planning isn’t simply about filling in a template. Family circumstances, property ownership, trusts, substitute beneficiaries, vulnerable beneficiaries and many other issues can completely change the advice someone needs.

You should feel comfortable asking the person preparing your Will about their training, professional membership and insurance.

And if somebody tells you they’re a member of a professional organisation, ask to see their membership card. Mine is pictured here. 👆
