Window cleaner injured after ladder fall.....
Mr Robinson was employed as a window cleaner when he fell off a ladder which had not been secured to the ground. Mr Robinson was left with a broken wrist as well as soft tissue damage to his face and head. Due to not receiving appropriate training, Mr Robinson felt he was not at fault for the accident but that rather his employer had failed in his duty of care to ensure his safety.
Lindsey, accident at work specialist here at Russell Worth, was in agreement with Mr Robinson and more than happy to represent him in a personal injury claim. Mr Robinson’s employers denied they were responsible for the accident, instead placing the blame firming back on him.
Undeterred, Lindsey continued with the claim and obtained a Barrister’s advice. Lindsey also arranged for Mr Robinson to attend a medical expert who prepared a report to support the link between his injuries and the accident. To put pressure on the other side to put forward an offer of compensation, Lindsey then issued Court proceedings.
It would seem that the other side were not confident enough in their denial of responsibility to risk attending Court and offered Mr Robinson the sum of £1,050.00 to settle the claim. Lindsey advised Mr Robinson this offer was far too low and it was subsequently rejected. Eventually, Mr Robinson accepted an award of £7,000.00 in full and final settlement of his claim. This sum included compensation for pain and suffering as well as financial losses such as loss of earnings.
