Acting as an Executor is an important legal role, but many people underestimate the level of responsibility involved.

Under UK law, Executors must act in the best interests of the estate and its beneficiaries. This includes safeguarding assets, keeping accurate accounts, and ensuring that all debts, taxes, and liabilities are settled before any distributions are made.

One key risk is distributing the estate too early. Under the Inheritance (Provision for Family and Dependants) Act 1975, certain individuals may bring a claim against the estate if they believe reasonable financial provision has not been made. Claims must generally be issued within six months of the Grant being issued.

Executors are also responsible for placing Trustee Act notices to protect against unknown creditors and ensuring full disclosure to HM Revenue and Customs when reporting estate values.

When someone passes away in England or Wales, their estate may need to go through Probate before assets can be distributed. Probate is the legal process of obtaining authority to deal with a person’s estate, either through a Grant of Probate (where there is a valid Will) or Letters of Administration (where there is no Will).

Probate is usually required if the deceased owned property in their sole name or held significant assets such as bank accounts, investments, or shares. Many financial institutions set their own thresholds, but estates exceeding £5,000 to £50,000 often require a Grant before funds can be released.

Executors or Administrators are legally responsible for:
• Valuing the estate
• Reporting to HM Revenue and Customs
• Paying any Inheritance Tax due
• Settling debts and liabilities
• Distributing assets to beneficiaries

Inheritance Tax must generally be reported and, in many cases, paid within six months of the end of the month of death to avoid interest charges.

Administering an estate carries legal duties and potential personal liability. Taking professional advice can ensure compliance with current legislation and protect you from costly mistakes.
