Spotlight on Mediation

We have just had a Good Divorce Week and now, between the 16th and 20th January 2023 there is a Family Mediation Week.

There will be a large degree of crossover between the two – that is how to achieve a good divorce, using the benefits of family mediation.

Dispute resolution is key to navigating your way through relationship breakdown and making the best arrangements you can for the children of separated parents.

Mediation is the most accessible and economic resource for avoiding court applications. There are other dispute resolution alternatives, such as arbitration instead of court, collaborative law, instead of the traditional one party one solicitor relationship and there are even some firms who offer a service acting for the couple together, rather than each requiring their own representation.

This would not suit everybody, but mediation is appropriate for the majority of situations and can adjust to cope with different scenarios, such as separate meeting rooms and including the children.

Family mediation is not a rigid legal process and Belinda Smith & Co will explain how it works and the extensive benefits it provides in reducing the stress of divorce.

A Good Divorce

If you are sadly facing a separation in the New Year, there are different ways the two of you can approach this traumatic life-event.

Resolution, the national organisation representing 6,500 family justice professionals, who believe in a constructive, non-confrontational approach to family law matters, have just held a Good Divorce Week to publicise the many alternatives to court available to separating couples, and to lobby MP’s for more help in providing such support.

Ten years ago, legal aid was withdrawn from family cases and since then, separating families have found it harder to access help and information about their options. By providing legal advice and information early in the process, couples are more likely to understand their rights and responsibilities, and are more likely to seek alternatives to court.

One of the most successful, is mediation which, since the change in the law in 2013 has declined dramatically placing further pressure on overstretched family courts. Mediations are currently running at around half the level they were 10 years ago, 13,609 down to 7,369 last year.

At a time when the family courts and the judiciary are suffering from a lack of resources and a massive backlog, and the spouses and their children suffer avoidable stress from delay, we believe early legal advice is a vital part of the solution.
