After several months of strict lockdown with only moves which were essentially required being allowed, the property market re-opens as of 29th June as part of Phase 2 of the Scottish Government’s route map out of lockdown.

Transactions may now proceed and properties can once again legitimately be introduced to the market without fear of breaching the lockdown regulations.

Property professionals have been issued clear guidance by the Holyrood on the subject.

The ESPC, which we are members of have popped these into a handy one stop page. The link is undernoted and we would encourage you all to read these carefully.

Some of you may have seen articles in the news similar to the undernoted one from BBC News in the past few weeks. In this worrying time for us all we have seen a huge surge in clients instructing us regarding the preparation of Wills and Powers of Attorney caused by fears surrounding the current COVID-19 pandemic.

These articles are specific to the law in England and Wales, where the rules for Will writing date back to the beginning of Queen Victoria's reign in 1837.

In Scotland, the procedure for signing Wills is governed by the Requirements of Writing (Scotland) Act 1995, as amended.

Our governing body, the Law Society of Scotland, has handed down clear guidance to our profession which re-affirms the fact that, in Scots Law, the English experience does not apply.

Provided that the prescribed procedure is followed correctly, Scottish Wills can be signed by means of a video conference call, with us remotely witnessing your signature. Once the signed Will is returned back to our office we can then physically subscribe our own signature on your Will and complete the signing process to make the Will valid in accordance with the legislation.

A similar process has been approved for Powers of Attorney as well.
