Something fun for Friday Episode 2 of Ask Austin There is a serious message though … you must sign your deposit agreement before the deposit is paid. If not, it’s arguably worthless. Hit FOLLOW and LIKE if this is helpdul

The golden takeaway is this …
All parties must sign the sale and purchase agreement for a horse before payment is made. This is because the contract completes once the purchase price is paid and so agreeing terms of a contract after that is arguably useless as the terms will be void. Please LIKE and FOLLOW if my snippets of advice are useful.
And SAVE for a rainy day if you may buy a horse or pony in the future.

One of the negatives of being a Lawyer are the unkind words I sometimes receive from my opponent, specifically where my opponent is a litigant in person. I suspect that my opponent has forgotten that I am a professional acting in the best interests of my client. It’s not personal. Don’t shoot me down for being good ….. I concluded a case at trial last year where the seller refused to return a £20,000 deposit. The pony failed the vetting and the seller refused to return the funds. The purchaser won in court and so the seller was ordered to pay back the £20,000 plus the legal costs. In this case the deposit agreement could have saved the seller £30,000 plus her own solicitors fees (because the terms of agreement would have been clear to all the parties). That’s quite a saving from a £29.99 agreement!
