The accident:
A lady contacted Actons Injury Solicitors after she was bitten by a dog whilst delivering leaflets as a self-employed contractor. She attended the property, there were no warning signs to warn her that there was a dog at the property and there was no sign of a dog or barking at the house.

As she proceeded to post a leaflet through the door she was bitten by a dog on the other side.

The injuries:
Our client was advised that she had suffered a small fracture to her finger and had to have stitches. She was also prescribed antibiotics. Whilst she recovered fairly quickly she was left with scarring on her hand and a slight misshapen end of her finger.

Itโ€™s a wonderful time of year, or is it? The Royal Society for the Prevention of Accidents tells us that more than 80 thousand people go to A & E over the festive season. Obviously, not all of those accidents give rise to a claim but many situations do and here are some of those situations.

Itโ€™s also a good idea to make sure the lights and wiring meet safety standards to avoid fires and the risk of electrocution and watch where you run those cables to avoid tripping hazards!

๐’๐ง๐จ๐ฐ ๐š๐ง๐ ๐ข๐œ๐ž โ€“ itโ€™s probably unlikely we will see a white Christmas Day, but the cold spell brings frost and ice and sometimes snow and extra care should be taken when out shopping in the supermarket or retail car parks or on our high streets, and on public staircases and steps. Local authorities and retailers have a duty to you, a duty to risk assess and to prevent where possible, or to reduce the risk of injury. There are duties to grit in certain places, place mats in doorways, clean, dry and keep walkways clear from clutter, provide handrails where appropriate and to try to prevent trips, slips and falls.

๐–๐จ๐ซ๐ค๐ฉ๐ฅ๐š๐œ๐ž ๐š๐œ๐œ๐ข๐๐ž๐ง๐ญ๐ฌ โ€“ apparently there is an increased risk of an accident or injury whilst in the course of your employment, at this time of year. Itโ€™s a busy time for manufacturers and we see employers taking on a lot of temporary workers to deal with a high demand. Employers are under a duty to provide a safe place and system of work with appropriate equipment. Standards shouldnโ€™t slip in the run-up to the holidays. American Bullies are a relatively new breed, originating in the 1980s. They are mixed breed Bulldogs, often being bred with Mastiffs and other larger breeds to make them bigger โ€“ commonly known as the XL Bully.

Often seen as a โ€˜status symbolโ€™, they are growing in popularity and are renowned for their intimidating looks and sheer strength. Males can weigh anywhere between 70 and 130 pounds.

Experts are now at pains to warn of their potentially dangerous nature, especially if they are not correctly trained or their aggression is encouraged, posing a real threat to humans and in particular, children.

The Home Secretary has now spoken out over recent, horrific attacks branding the American XL Bully as a clear and lethal danger to communities, particularly to children and has commissioned urgent advice on banning this breed of dog.

We believe it is time for the Dangerous Dogs Act to be overhauled, with tougher penalties to be considered for irresponsible dog owners/keepers.

Recent research has shown that American Bully-type dogs have been responsible for 44 per cent of all reported attacks by dogs since the start of the year, with the XL Bully involved in 22 per cent of all attacks.

Last year there were 22,000 dog attacks causing injuries in England and Wales, a rise of 4,000 since 2018.

We were instructed to act on behalf of a client in connection with a slip in a supermarket which resulted in personal injuries.

Our client was visiting the store to do some shopping. As she was making her way along the aisle, she slipped on an oil spillage. A wet floor sign had been placed by a member of staff, but this was more than 3 metres away from the oil, and its view was obstructed. Or the customer opens the door and out escapes the family dog, who has taken a dislike to you and decides to attack and bite youโ€ฆ Sound familiar?

Did you know that there have been over 2,700 dog bite attacks on Royal Mail delivery workers since 2015? During the year up to March 2023, Royal Mail recorded 1916 dog attacks. Thatโ€™s 37 a week (an increase from the year before, which saw 32 a week). So, the overall figure seems set to take a steep increase. According to Royal Mail, Tunbridge Wells had the most dog attacks up to the end of March 2023, followed closely by other cities such as Sheffield, Belfast, Nottingham etc., with most dog attacks (47%) taking place at the front door. The threat is worst for delivery workers during the summer holidays, according to Royal Mail, when residents are more likely to be at home and their dogs are running free in the garden etc.
