Cohabitation generally refers to two people living together in the same home (either owned in joint names or in the name of either party) as a couple but who are not married to each other or in a civil partnership.

Long-awaited reforms could offer greater protection for unmarried couples who live together.

For years, cohabiting couples have had far fewer legal protections than married couples or civil partners, even when they share a home, have children, or have built a life together.

The Government is now looking at changes to cohabitation law that could give couples clearer rights if they separate, including financial protection, property claims, and greater consideration of domestic abuse when financial decisions are made.

It is also considering whether cohabiting partners should have inheritance rights if one partner dies without making a will.

For many families, this could be a welcome step towards recognising modern relationships. However, the law has not changed yet.

Until any reforms are introduced, cohabiting couples should protect themselves by making a Cohabitation Agreement, recording property ownership clearly, and making or updating their Wills.

Do not wait for the law to change. Putting the right legal protections in place now can help reduce uncertainty and protect both partners.
