The UK Government has confirmed reforms to Agricultural Property Relief (APR) and Business Property Relief (BPR) that are scheduled to come into affect from 6 April 2026.

What’s Changing?

• A new £1 million allowance will apply to the combined value of property qualifying for 100% APR or 100 % BPR for individual estates.
• For any qualifying property over that £1 million allowance, the relief rate drops from 100% to 50%.
• For trusts, a £1 million allowance will apply to qualifying agricultural and business property.
• The rate of BPR for certain shares will be reduced - shares admitted to trading on a recognised stock exchange but designated as ‘not listed’, and shares listed on foreign exchanges which are not a recognised stock exchange, will see relief fall to 50%.
• The option to pay Inheritance Tax (IHT) by interest-free instalments over 10 years will be extended to all property eligible for APR or BPR.
• Standardised calculation of trust exit charge rates - for a trust exit event (after the 10-year anniversary) the calculation will be based on unrelieved values, regardless of when the exit happens.

Scheduled to take effect from 6 April 2027, most unused pension funds and pension death benefits will be included in someone’s estate for the purposes of Inheritance Tax (IHT).

What’s Changing?

• If a person dies on or after 6 April 2027, any unused pension money and certain death benefits from their pension scheme will count towards their estate when IHT is calculated.
• Personal representatives will be responsible for reporting and paying any IHT due on these pension assets.

What’s Not Changing

• Death in service benefits paid from a registered pension scheme will not be included in the IHT calculation.
• The existing IHT principles providing exemption for death benefits passing to a surviving spouse or civil partner, and registered charities will be maintained.

✔ Housing and financial needs of both parties
✔ Income, earning capacity, property and other financial resources
✔ The standard of living during the marriage
✔ Age of each party and the duration of the marriage
✔ Contributions made, both financial and non-financial (such as childcare)
