Caring for a loved one who can no longer make decisions for themselves is mentally and physically challenging. đź’™

On top of the day-to-day challenges, there is the legal aspect to consider too. A Personal Welfare Deputy is someone authorised by the Court of Protection to make decisions about medical treatment and daily care on behalf of someone who lacks mental capacity, whether due to dementia, a brain injury, or learning disabilities.

If you want to apply to be a Personal Welfare Deputy for someone you love, you will need to consider these things first:

1. Check for an LPA/EPA. If a Lasting Power of Attorney or Enduring Power of Attorney already exists, you usually won't need a deputy.

2. If you’re managing benefits only, you don’t need to be a deputy, you can apply to become an appointee instead.

3. You will need a professional (such as a doctor or social worker) to complete a formal mental capacity assessment (a COP3 form) as part of the application.

4. Applications involve court fees and typically take several months to process, so planning ahead is essential.

Once appointed, you must make decisions strictly in their best interests and submit an annual report to the Office of the Public Guardian (OPG).

If you’d like friendly and compassionate advice on this deeply personal process, our team is here to help.

When someone can no longer manage their finances, who can step in?

If a person lacks the mental capacity to manage their own financial affairs and doesn't have a suitable Lasting Power of Attorney in place, a property and financial affairs deputy can be appointed by the Court of Protection.

A deputy might be able to deal with matters on the person's behalf, like paying bills, managing bank accounts, receiving benefits or pensions, and dealing with property.

But the important thing to remember is that a deputy does not automatically have unlimited authority. The exact decisions they can make, and the extent of their powers, are set out in the Court of Protection order appointing them.

Applying to become a deputy can be a complicated process, especially when decisions need to be made about someone's home, their finances, or their long-term care.

We can give you clear legal advice and support with Court of Protection matters, helping you understand the process and what needs to happen next.

Many people assume a Lasting Power of Attorney is something to worry about later in life, but government guidance states that a Lasting Power of Attorney (LPA) can only be created while you still have full mental capacity.

If an unexpected illness or injury occurs, your family may be unable to take part in decision-making on your behalf without going through an expensive and drawn-out court application. An LPA is the legal document that solves this. There are two distinct types available:

1. Health and welfare LPAs cover medical treatment, daily care routines, and housing decisions. This type only takes effect if you lose mental capacity.

2. Property and financial affairs LPAs cover paying bills, managing bank accounts, pensions, and selling property. This can be used as soon as it’s registered (with your consent) or only if capacity is lost.

Getting organised today lets you stay in control of what happens if you if you lose capacity, rather than leaving it to a local authority or court. It also saves your loved ones from the far more expensive and lengthy process of applying for a Court of Protection deputyship during a difficult family time.

When a loved one loses capacity, what happens next?

A Court of Protection deputy is appointed when someone loses mental capacity due to a health condition or accident, and no Lasting Power of Attorney is in place.

Two types handle different affairs:

A property and financial affairs deputy handles day-to-day finances, paying care fees, managing pensions, or selling a property.

A personal welfare deputy makes decisions regarding daily care routine, medical treatment, and living arrangements.

Every deputy carries a strict responsibility to act in the individual’s best interests and remain within the authority granted by the Court order.

When a family member's circumstances undergo a drastic change, the last thing needed is to be dealing with complicated legal terms and processes. Our sensitive team is here to guide families through the entire application process, getting your legal protections in place while you care for your loved one.
