Fluctuating Capacity, Obstetric Care and Anticipatory Declarations

When a pregnant woman with severe psychosis faces a foreseeable obstetric emergency, how can clinicians balance patient autonomy with the need for safe delivery? In University Hospitals of Derby and Burton NHS Foundation Trust & Anor v HH [2026] the Court of Protection considered capacity, best interests, and the use of anticipatory declarations, providing guidance on managing fluctuating capacity in high-risk maternity care.

Newcastle councillors have voted to scrap the city's late-night levy — a fee charged since 2013 to city-centre businesses licensed to sell alcohol late at night, funding late-night policing, CCTV and taxi marshals.

Sarah Smith, Head of Licensing at Sintons, explains: introduced under the Police Reform and Social Responsibility Act 2011, the levy has been dropped by most other UK cities over the years, leaving Newcastle as one of only a few still charging it.

Sarah says: "The upside of not paying the late-night levy is that operators will save costs. But I think the bigger gain is that they'll feel their concerns about fairness and rising costs have been heard by the Council. The funding will need to come from elsewhere, but I don't anticipate a negative impact from its removal."

Sintons advises on the launch of Blue Lagoon Fish & Chips in Newcastle.

We're proud to have supported the launch of the first English site for popular Scottish restaurant chain Blue Lagoon Fish & Chips.

The family-run business began in Glasgow over 50 years ago and now has 16 venues. Its newest restaurant opens soon in Newcastle's Bigg Market, with a 60-seat restaurant and takeaway facilities.

Director Simone Varese wanted extended trading hours to capture both daytime trade and the area's late-night economy. Our Licensing Partner, Sarah Smith, secured this despite objections from the Police, Local Councillor, Licensing Authority and Public Health - successfully engaging with each to reach an outcome that works for the venue from day one.

Simone said: "I would absolutely come to Sintons to work with Sarah again."

Court of Protection & severe anorexia: when does a case really need judicial involvement?

In Birmingham and Solihull Mental Health NHS Foundation Trust v CG [2026] EWCOP 37, Mrs Justice Theis granted permission to withdraw proceedings where there was clear clinical consensus and no live dispute — a useful reminder that grave decisions don't automatically require court approval.

Trainee Challenge 2026: complete! ✨

Over two days, they walked 26 miles around London, following the same route as the iconic London Marathon, all in support of St Oswald's Hospice.

We're incredibly proud of the whole team for taking on the challenge and seeing it through - every one of those miles for a brilliant cause.

A huge thank you to everyone who has followed along, cheered them on and donated over the last few days - it really has meant so much. And thank you again to Montane Ltd for their kind support.

There's still time to donate if you haven't already - every contribution makes a difference.
