In LMND Group Ltd v John Henry Group Ltd (Dec 2025), the court refused enforcement of an adjudicator's decision after finding a material breach of natural justice — the adjudicator had ruled on an estoppel defence based upon arguments and authority that neither party had put forward and had no opportunity to provide submissions upon.

This is a rare example of a successful resistance of an adjudicator’s decision.

Supreme Court overturns Cheshire West - AG for Northern Ireland [2026] UKSC 16.

In AG for Northern Ireland [2026] UKSC 16, the Supreme Court has reset the law on deprivation of liberty by unanimously overruling the 2014 Cheshire West judgment and rejecting the long-standing “acid test”, returning to the multi-factorial, context-sensitive approach which aligns with Strasbourg jurisprudence on the Art 5 right to liberty.
