Yesterday we attended Markel’s annual PI conference hosted at No5 Barristers' Chambers in Birmingham.

There was an excellent line up of speakers covering a range of interesting and engaging topics, followed by networking on the impressive Eighteen roof terrace. It was lovely to catch up with familiar faces and make new connections with peers across the legal profession.

Thank you to Markel for organising a fantastic event and No5 for hosting us!

✨ September Settlements Spotlight ✨

🚲 Cycling Accident

Our client was cycling through a newly landscaped area when they fell from their bike due to inadequate warning of a hidden single step. They sustained a fractured left shoulder and ultimately required a total shoulder replacement. Following the accident, the area was revamped and the single steps were removed. Liability was subsequently resolved and damages were recovered for our client.

🏥 Care Setting Accident

Our client suffered a fractured arm after falling from a bed while in a care setting. Liability was disputed, but following negotiations, we were able to secure a settlement for our client.

⚠️ Pub Accident

Our client tripped over a single step in a pub, causing them to fall forwards onto glasses which smashed into their face. They sustained multiple facial lacerations and scarring. Despite liability being disputed, we successfully negotiated a settlement on their behalf.

A recent BBC news report has highlighted the devastating consequences of an alleged misdiagnosis, after a patient was told at the age of 21 that she had a terminal brain tumour and subsequently underwent 11 years of chemotherapy.

She has now been told that she did not have a brain tumour, but instead had tumefactive demyelination - an inflammatory condition which can mimic a brain tumour and may be treated with steroids.

The BBC reports that more than 40 patients are taking legal action against University Hospitals Coventry and Warwickshire NHS Trust in relation to allegations of prolonged or unnecessary cancer treatment.

The impact of an incorrect diagnosis and unnecessary treatment can extend far beyond the patient's physical health. In this case, years of chemotherapy affected the patient's career, family life and everyday activities.

✈️ Airport Accident
Our client was boarding a flight when he slipped on icy conditions at the top of the aircraft stairs. His leg fell into a gap between the stairs and the aircraft, becoming trapped and causing extensive contusions and muscle damage to his leg.

🐕 Dog Bite Claim
Our client was bitten by a dog that had entered a gym, suffering puncture wounds to their lower leg. Although liability was denied by the gym owner, liability was admitted by the dog owner and we successfully recovered damages for our client.

🌳 Occupiers' Liability Claim
Our client caught his foot on a tree root which had lifted a pathway by approximately 5cm, causing him to fall heavily onto his right knee and forearms. Liability was admitted by the local authority and compensation was successfully recovered.

A recent case reported in the Northumberland Gazette highlights the devastating consequences that can follow when appropriate measures are not in place to protect workers from falls through fragile roofs.

Unfortunately, this is something we see far too often. What may appear to be a routine task can result in a serious accident, with injuries that can affect someone’s health, career, finances and family life for years to come.

Employers have a responsibility to identify risks, put appropriate safety measures in place and ensure that workers are properly protected.

Cases such as this are an important reminder that workplace safety should never be treated as an afterthought.
