I cannot stress how important an LPA can be. Hopefully you don't need it, but if you ever do then it can save you money and heartbreak.

Lasting Power of Attorney!

JARGON BUSTER: What is "Lasting Power of Attorney"?

A Lasting Power of Attorney (LPA) is a way of giving someone you trust, your attorney, the legal authority to make decisions on your behalf, for instance if you lose mental capacity at some point in the future. The LPA is a legal document made whilst you still have mental capacity. Your family may face long delays and expenses if you fail to establish an LPA and become mentally incapacitated, since they will have to apply to the Court of Protection for access and control of your assets.

What is the role of a Guardian?

The role of a Guardian is a very important one and should be put in place when thinking about protecting your family.

The act of appointing Guardians when a Will is made ensures that young children do not have to be placed into care until the Court appoints official Guardians to look after them, saving the children and family members from further distress at such a difficult time.

The normal choice is to appoint family members, particularly where very young children are involved. As children grow, the appointment of friends may be more appropriate as they are more likely to share the deceased parents lifestyle and ideas.
The age of the Guardians should always be considered and it is advisable to appoint more than one to avoid potential problems which may arise from ill health, death, etc.
