📢Could prenups soon become legally binding – and could cohabiting couples get greater protection?

Family law in England and Wales could be heading towards some important changes.

The Government is currently consulting on proposals to introduce Qualifying Nuptial Agreements. These could allow couples to make legally binding financial arrangements in advance of divorce or dissolution, provided the agreement meets the required safeguards.

Proposals are also being considered for a new statutory framework of financial rights and protections for eligible cohabiting couples when their relationship ends.

Many people still believe in the idea of a “common law marriage”, but there is currently no common law marriage giving cohabiting couples the same financial rights as married couples. Any proposed protections for cohabitants would not be the same as the financial remedies available on divorce or dissolution.

These proposals could significantly change how the law treats financial arrangements between couples when relationships end.

Importantly, the law has not changed yet. The Government’s consultation is currently open until 14 August 2026.

We're delighted to introduce our Solicitor and Wills & Probate Head of Department, Gemma Brownlow.

Gemma specialises in Wills and Estate Planning, Lasting Powers of Attorney, Court of Protection matters, Probate and Estate Administration, guiding clients through complex and sensitive matters with a friendly and approachable manner.
