Did you know probate may still be required even if all assets were jointly owned? 🤔

It’s a common belief that jointly owned assets always pass automatically to the surviving owner. While this can be true for assets held as joint tenants, probate may still be needed in certain situations.

If assets were owned as tenants in common, the deceased’s share forms part of their estate and may require a Grant of Probate or Letters of Administration before anything can be dealt with. In some cases, banks or financial institutions may also ask for formal authority before releasing funds, even where assets seem to pass outside the estate.

Ownership structures can be confusing, especially at an already difficult time. Taking early advice can help avoid delays and ensure everything is handled correctly.
