Recent changes in the law mean that the moment you work with other tutors, you are legally considered a Tutor Agency. This applies whether you employ tutors or work with self‑employed tutors.
The only exception is when you simply recommend tutor names to a client with absolutely no payment or benefit passing between you and the tutors.
If you are a Tutor Agency, you must operate as either:
- an employment business, or
- an employment agency
Which one applies depends on how you work:
You’re an employment business if:
- The client contracts with you
- The client pays your agency
- You then pay the tutor
- The client can contact you (or the tutor) for things like rearranging sessions or getting updates
You’re an employment agency if:
- You introduce the client to the tutor
- The client forms a direct relationship with the tutor (in this model all queries must go
directly to the tutor)
- The client pays the tutor directly for the tutoring
