The issue of non-disclosure of assets can have enormous impact on the financial part of divorce proceedings. Lucy Raho Jeavons of Hall Brown writes how one recent case has prompted an allegation that a businessman “got away with blue murder” by hiding the true extent of his wealth from the family court.

One of the fundamental elements of the process for obtaining a financial remedy on divorce in the courts of England and Wales is that of discretion.

More families are now choosing to resolve disputes about divorce and the well-being of children away from the courts. It is a development which Sarah Manning, the Head of Non-Court Dispute Resolution (NCDR) at Hall Brown, is very much familiar with. Nevertheless, as Chair of Family Law Mediation Week, she argues that intensive efforts to encourage individuals to settle their differences without the stress, delay, cost and uncertainty which is often associated with court proceedings needs to continue.

Most people who have ever tried to maintain New Year’s resolutions to the end of January, let alone the end of the year, will admit that changing habits is not necessarily easy.

As Head of its new office in Liverpool, Natalie Dickson explains why the time is right to offer clients on Merseyside the kind of support for which Hall Brown has become renowned nationwide.

There are just 35 miles between Liverpool and Manchester but, in many respects, there is something of a friendly rivalry between these two cities – which are among England’s biggest and most internationally renowned locations.

Recent research has suggested that some middle-aged spouses feel a sense of relief when their divorces are concluded. Isabella O’Donoghue of Hall Brown explains that although newly single life can present opportunities, it can also bring considerable challenges for those who have not sought specialist advice to ensure that they are fully prepared for what lies ahead.

Some may be going their separate ways after many years together and having to explain their decisions to children, family and friends.

Everyone at Hall Brown Family Law is shocked and saddened by the sudden death of our colleague and friend Jo Snelling.

Jo joined the support team at Hall Brown Family Law in March 2023 having previously worked at national law firm Irwin Mitchell for almost 40 years. She worked with many of our Sheffield colleagues both at Hall Brown and previously at Irwin Mitchell, for many years including some for over 30 years. Jo was such a kind, generous and deeply loyal person with a cutting sense of humour that will be forever remembered in our hearts. Having worked in Family Law for so long, as a secretary and support team member, Jo worked with and helped nurture so many young lawyers who now work all over the country and all of whom will remember her with fondness.

James Brown, founder and partner at Hall Brown Family Law says, “Jo was part of our family. Her larger-than-life presence will be missed by us all. We ask for your patience and understanding at this difficult time.”

Although the law governing financial remedy proceedings has been in force for more than half a century, discretion in how that legislation is applied to the individual circumstances of each divorce means that the process remains dynamic. Sarah Hewitt of Hall Brown writes that the impact of three landmark rulings from the last 25 years is likely to shape how spouses divide and try to protect their assets for some time to come.

Each and every divorce dealt with by family courts across England and Wales is dealt with according to statute, legislation put in place by parliament.

Figures published recently by the Office for National Statistics show that 3.8 million men and women experienced domestic abuse in the last year. The data’s release coincided with the launch of a new Government initiative to tackle violence against women and girls. Sarah Manning of Hall Brown Family Law argues that whilst the scheme - and the ongoing pilot of a new Domestic Abuse Protective Order (DAPO) - show that progress is being made in addressing the problem, more still needs to be done.

There was a time when domestic abuse was regarded as something of a nasty, little secret – something which happened inside only certain homes and wasn’t talked about in public.
