Many people coming to us for the first time ask one similar question: 🤔 What does mediation actually involve?

🙏 Mediation is designed to help separating couples talk things through in a constructive setting, rather than turning straight to court. It can reduce stress, save time and cost, and give families more say in the decisions that affect them.

📍At Frances Lindsay & Co, we guide clients through mediation with clear advice and careful preparation. If agreements are reached, we can also help make sure they are properly formalised so they are secure and workable for the future.

If you’re unsure whether mediation is right for you, we’re always happy to talk it through.

Court decisions can bring matters to an end, but they don’t always help families move forward. ▶️

Mediation looks beyond legal outcomes and focuses on the realities of everyday life after separation. It gives people the space to talk through arrangements, understand each other’s concerns, and find solutions that actually work in practice.

This week marks "Family Mediation Week", with a series of helpful webinars hosted by Family Mediation Council for those considering mediation. https://www.familymediationcouncil.org.uk/family-mediation-week-2026-timetable/

📍 At Frances Lindsay & Co, we’ve seen how mediation can help families reach clearer, more workable outcomes. If you’re considering your options, we’re here to talk things through and help you decide what feels right for you.

💍 January is often when people finally pause. After the pressure of Christmas and family expectations, the return to normal life can bring long-standing issues into sharper focus.

💫 When the New Year begins, people often feel they have the space to think clearly and start asking practical questions. For many, this is not about sudden decisions. It is about timing. Parents often wait to get through 🎄 Christmas for their children’s sake. Others delay because finances feel uncertain, or because the emotional step feels too big.

❄️ January can feel like a natural point to stop postponing and start looking for information. Reaching out for advice does not mean you have made a final decision. It simply means you want to understand your options and what support is available.

🤝 At Frances Lindsay & Co, we help people navigate separation and divorce with clarity, care, and practical guidance - every day. Whether you are just thinking things through or ready to take the next step, we are here to help at your pace.

🤔 If your hearing has been cancelled or adjourned at short notice, it’s completely natural to feel anxious or assume the worst. Remember, there are plenty of normal reasons as to why this may happen:

1. Court availability.
Judges and magistrates are people, too. They can be unwell, unavailable, or reassigned at short notice. Many magistrates are volunteers, and court timetables can change quickly.

2. Urgent cases taking priority.
Family courts handle thousands of applications every quarter. When a case involving immediate risk or safeguarding concerns comes in, it may need to be heard urgently, which can affect other listings.

3. Delays with reports or information.
Courts often rely on reports from other agencies, such as Cafcass or the police. These organisations are under huge pressure, and delays in receiving information can mean hearings need to be rearranged.

🕰️ A postponed hearing usually reflects the wider pressures on the family court system - not the strength of your case. If you’re unsure what a delay means for your situation, or what happens next, getting clear advice can help you feel more in control.

💬 It’s a question many people ask, often out of fear, uncertainty, or a desire to protect themselves. The short answer is that you need to be very careful.

✍️ Once divorce proceedings are underway, both parties have a legal duty to be open and honest about their finances - think property, savings, pensions, investments, and even assets held in someone else’s name.

🏡 Moving money, selling assets, or giving them away without agreement can cause serious problems later on.

👛 If assets are moved to hide them or put them out of reach, the court can step in, and in some cases, it can reverse transactions, make orders to recover money, or draw negative conclusions about the person’s behaviour.

💳 However, paying everyday bills, covering childcare costs, or meeting legal fees is expected, and as long as it is reasonable and transparent, then you can relax.

🤔 If you are worried that your former partner may move assets, or you are unsure what you are allowed to do, getting advice early can make a real difference.

✅ Divorce is stressful enough without added financial risk. If you need clear advice on separating calmly, our family law team is here to help. Message us to arrange a confidential chat or visit the link in bio to speak with our team. 🔗
