Lahore High Court Issues Landmark Ruling on Negligence and Delay in Criminal Investigations
The Lahore High Court has issued a landmark judgment addressing negligence and delays in the criminal investigation system.
The Court directed the Inspector General (IG) of Punjab Police to conduct a province-wide audit of all pending investigation cases.
The Court ordered all police officers to audit cases within their respective jurisdictions and immediately rectify any investigative shortcomings.
The Court emphasized strict compliance with legal requirements regarding the timely submission of challans (police reports) and the daily maintenance of case diaries.
The Court further directed that any future investigative negligence must be dealt with promptly to prevent its recurrence.
The IG Punjab was instructed to immediately circulate a copy of the judgment to all Regional Police Officers (RPOs), City Police Officers (CPOs), and District Police Officers (DPOs).
The IG Punjab was ordered to submit the audit report to the Court by 20 January.
The Court observed that safeguarding the liberty of citizens is a sacred constitutional duty of the judiciary.
The Court held that unjustified or prolonged pre-trial detention is tantamount to imposing punishment before conviction.
The Court noted that the police had made no genuine effort either to arrest the accused or to have him declared a proclaimed offender.
The Court ruled that an accused cannot be made to suffer the consequences of police inefficiency, negligence, or incompetence.
Since the investigation had already been completed and no further recovery was to be effected from the accused, the Court held that there was no justification for his continued detention.
The Court observed that after submitting the challan, the police had virtually abandoned the investigation.
The investigation file remained buried in dust for 6 years and 3 months, which the Court described as criminal negligence.
The prolonged disappearance of the investigation file reflected a serious administrative failure within the district police.
The Court held that delays in investigation violate a citizen's fundamental right to a fair trial and due process of law.
Justice Muhammad Tariq Nadeem issued the 12-page written judgment.
The High Court granted bail to the accused, Tanveer Ahmad, and ordered his release.
According to the allegations, the accused was charged with breaking the complainant's right leg and striking his back with the blunt side of an axe.
The prosecutor submitted that the accused had remained absconding for 6 years, 10 months, and 19 days after the incident.
The prosecutor further argued that, due to his abscondence, the accused had forfeited his right to seek bail.
