OUR THOUGHTS ARE WITH NEPAL 🇳🇵

The devastating floods and landslides affecting Nepal have left communities facing an unimaginable situation.

Since 26 August, severe flooding in the Rasuwa district and areas around the Nepal–China border has caused widespread destruction, affecting homes, roads, bridges, communications and essential infrastructure. Hundreds of people have lost their lives and thousands remain missing as rescue efforts continue.

For the Nepali community here in the UK, these events will be particularly difficult as families wait for news of loved ones and communities come together to support those affected.

The UK Government has announced £5 million in humanitarian support for Nepal and has deployed additional consular staff to assist British nationals and their families affected by the disaster.

At Visa Legal, we stand with the people of Nepal and everyone affected by this tragedy.

🎓 **STUDENT SPONSORS: ARE YOU READY FOR THE TOUGHER COMPLIANCE STANDARDS?**

The Home Office has recently demonstrated that Student sponsor compliance is being taken seriously.

On 5 August 2026, the Student sponsor licence of Bloomsbury Institute was revoked after the institution failed its Basic Compliance Assessment.

The timing is particularly important because Student sponsor compliance standards were strengthened from **1 June 2026**.

Sponsors are now subject to:

📌 Visa refusal rate below 5%
📌 Course enrolment rate of at least 95%
📌 Course completion rate of at least 85%

And from assessments submitted from **June 2027**, the course completion threshold will increase to at least **90%**.

For education providers, this is an important reminder that holding a Student sponsor licence comes with ongoing responsibilities.

Failure to meet the required standards can result in enforcement action, including the loss of the sponsor licence.

The Home Office has said its priority is to protect students and the integrity of the Student route.

The UK has expanded its Global Talent visa route to make it easier for more innovative businesses to attract leading international researchers.

More than **100 UK research-intensive companies** can now support eligible researchers through the Global Talent visa's Endorsed Funder pathway.

The expansion covers businesses working in areas including:

🧬 Life sciences
🤖 AI and digital technologies
⚛️ Quantum technologies
🌱 Clean energy
🏭 Advanced manufacturing

This is significant because, for the first time, eligible researchers working on funded projects can be supported in their move to the UK by approved research-intensive businesses, alongside universities and research institutes.

The Government says the Global Talent route has already supported more than **12,500 researchers from over 130 countries** through the Endorsed Funder pathway.

For the UK, attracting international research talent can help drive innovation, investment and highly skilled jobs.

For eligible researchers, it creates more potential opportunities to build a career in the UK.

🌟 POSITIVE UK IMMIGRATION UPDATE FOR SOME FAMILIES

A change to the UK Immigration Rules came into force on **3 August 2026** which could be welcome news for some families on the Graduate route.

Previously, the rules did not clearly provide a route for a **child born in the UK while their parent held Graduate route permission** to apply as that parent's dependant.

The rules have now been amended.

👶 A child born in the UK during a parent's current Graduate permission can now apply as a dependant.

If the requirements are met, the child can be granted permission **in line with the parent's existing Graduate permission**.

Why does this matter?

The Home Office acknowledged that the previous rules had left a small group of UK-born children without a clear route to dependant permission. This amendment addresses that gap.

⚠️ There are important limits.

This is not an automatic grant of immigration status, and it does not mean that every child of a Graduate visa holder qualifies. The child must meet the relevant Immigration Rules, and the change specifically concerns children **born in the UK during the parent's Graduate permission**.

💡 A LITTLE-KNOWN UK IMMIGRATION RULE CHANGE THAT COULD HELP SOME APPLICANTS

There has been a small but potentially important change to the Immigration Rules that came into effect on 3 August 2026.

Previously, there could be a problem where an applicant fell within the Home Office's "Exceptions for overstayers" provisions but was also placed on immigration bail following an immigration decision.

In many relevant categories, being on immigration bail could prevent a further application from being made.

That has now changed.

From 3 August 2026, the relevant Immigration Rules have been amended so that, **where the Exceptions for overstayers provisions apply, being on immigration bail will no longer automatically prevent a person from making the relevant application.**

Why does this matter?

The Exceptions for overstayers provisions can, in certain circumstances, allow a person who made an application in time to make a further application within a specified period after their previous permission expires, with the period of overstaying disregarded.

The new change removes an important obstacle for people who may also have been placed on immigration bail.

⚠️ But this is NOT a general permission to overstay.

The Exceptions for overstayers rules are specific, and whether they apply depends on the individual's circumstances and immigration history.

"If I marry a British citizen, I automatically become British."

✅ FACT

Marrying a British citizen does not automatically make you a British citizen.

Marriage may make you eligible to apply for British citizenship under a different set of rules, but you must still:

✔️ Hold the required immigration status (such as Indefinite Leave to Remain or settled status, where applicable).

✔️ Meet the residence requirements.

✔️ Satisfy the good character requirement.

✔️ Meet the English language and Life in the UK requirements (unless exempt).

✔️ Submit a separate application for British citizenship.

Every case is different, and meeting one requirement does not guarantee that an application will be successful.

Instead, applicants will receive an eVisa, which is a secure digital record of their immigration status.

Before travelling to the UK, successful applicants should:

✅ Check their eVisa details are correct.
✅ Ensure their passport is linked to the correct UKVI account.

The move to eVisas is part of the UK's transition to a fully digital immigration system, making it easier to prove immigration status and reducing the risk of lost or damaged documents.

🚨 RIGHT TO WORK CHECKS ARE CHANGING – IS YOUR BUSINESS READY?

From 1 October 2026, significant changes to the UK's Right to Work framework are due to come into force.

The changes will expand Right to Work responsibilities beyond traditional employment in certain circumstances and could affect businesses that engage people through:

✔️ Worker's contracts
✔️ Individual subcontractors
✔️ Online matching platforms
✔️ Some substitution arrangements

The updated framework also introduces new compliance requirements for businesses seeking to establish a statutory excuse against civil penalties.

For many employers, sponsors and organisations using flexible labour models, now is the time to:

• Review existing Right to Work procedures.
• Assess contractual arrangements.
• Update compliance policies.
• Ensure HR teams understand the new requirements before October.

Businesses that fail to comply may face civil penalties of up to £60,000 per worker, alongside other enforcement action where applicable.

Although October may seem some time away, preparing now will make implementation much smoother.
