A trade mark registration is often key to protecting your brand. Below, we have outlined some of the reasons why you should consider filing a trade mark for your business:

✅ You want to prevent someone else from being able to use the same or even a similar name for the same or similar goods or services

✅ You are investing in physical product branding

✅ You plan on using the name long term

✅ To prevent infringing on another business who has registered a trade mark for similar goods or services

✅ You offer your products or services nationwide or globally

✅ Any businesses who intend to use a mark for a long time (whether it’s a business name, logo, slogan, product name, etc) should consider trade mark registration as soon as possible.

Legal is a necessary business expense.

Paid ads, SEO, business coaches, online courses, etc., are all valuable investments, BUT having a solid legal foundation is a necessary business expense.

You can not build a successful business or brand with shoddy legal foundations. If you try, you’ll inevitably:

Humans: 1, AI: 0 – at least in terms of this copyright case.

In recent months, we have received more and more enquiries surrounding AI work and right of ownership.

So, this week when our team came across the news that a federal judge in the US held that art created by artificial intelligence (AI) is not eligible for copyright protection, it piqued our interest.

The case revolved around claims brought by Stephen Thaler, who sought copyright protection for an image created using an algorithm he developed called the Creativity Machine. Thaler attempted to get a copyright on the image multiple times, saying the protection ‘should transfer to him as the owner of the machine’, according to court docs. However, the U.S Copyright Office (USCO) denied his initial application on the grounds that the work lacked ‘human authorship’, along with his requests for reconsideration.

After the USCO’s final rejection last year, Thaler filed a lawsuit against the Office, alleging that its denial was ‘arbitrary, capricious … and not in accordance with the law’. However, U.S District Judge Beryl A. Howell disagreed saying ‘human authorship is a bedrock requirement of copyright’. However, her ruling did acknowledge that copyright law is entering uncharted territory as artists increasingly utilise AI as a creative tool.

In March, the USCO issued guidance indicating its openness to granting copyright protection for works created with AI assistance on a case-by-case basis. However, the Office said that works entirely generated by AI would not be eligible for copyright, emphasising the importance of ‘human authorship’.

An interesting case and ruling. Like the judge said, it appears that there is ‘uncharted territory’ ahead.

So many business owners think that if you OWN a trade mark then you OWN that word or phrase, and that is not correct.

A trade mark™ = brand ownership, not word ownership.

When you own a trade mark, you do not have complete control over that word or phrase. But you can prevent other businesses that sell the same product or service as you from using the same or a similar name. You cannot, however, prevent someone from using the same or similar name for totally unrelated goods or services.

For example, Dove soap and Dove chocolate both own the trade mark DOVE and are able to co-exist as identical trade marks. This is because their products are so different that there is no likelihood of confusion.

However, if you wanted to open a restaurant, name it Barshu (i.e., the name of our client), and file a trade mark application of the same name, your application would most likely be opposed by our client since likelihood of confusion between the two restaurants exists and consumers would in all probability believe that Barshu Restaurant (i.e. our client) own or operate your restaurant.

Owning a trade mark means that you own the exclusive right to use your brand name in connection with your goods and services.
